1. General Conditions for All Europcar Cards
Europcar cards are personal and non-transferable.
1.1 / The Europcar nominative cards are non-transferable and can only be used by the person indicated on them (hereinafter referred to as the "holder"), whose signature in indelible ink must appear on the back. The card is the exclusive property of Europcar, and therefore, the holder must return it to the issuing entity when required.
Rental Conditions/Requirements
1.2 / All rentals are subject to the applicable Europcar General Rental Terms and Conditions.
1.3 / The issuance of a card guarantees that its holder is 21 years or older (23 or older for Privilege cards) and, at the start of the rental period, holds a valid driver’s license for the type of vehicle rented. Other conditions may apply depending on the rental country. These conditions are subject to change depending on the period, country, and season. These specific conditions can be requested at the Europcar Central Offices in the relevant country or at
www.europcar.com (menus at the bottom).
1.4 / The mere issuance of the card does not guarantee the holder the insurance coverage provided by Europcar. Insurance conditions are subject to changes based on the season, country, and rental office. These specific conditions can be requested at the Europcar Central Offices in the relevant country.
Card Cancellation
1.5 / In the event of theft, loss, or any other cause justifying the cancellation of the Europcar card, the holder must immediately notify the Europcar Central Office in their country of residence, indicating the Europcar identification number and providing the necessary information for card identification. The address of the Europcar Central Office can be found at
www.europcar.com.
1.6 / Any verbal notification must be immediately confirmed in writing. The cardholder will be held responsible for any fraudulent use of the card until Europcar receives written notice of its loss.
Card Expiry and Renewal
1.7 / The expiration month and year of the card appear printed on the card as MONTH MONTH YEAR YEAR. The expiration date corresponds to the last day of the printed month. After this date, the card will no longer be valid.
1.8 / Cards will be automatically renewed by Europcar unless Europcar or its holder has canceled or invalidated them, or if the card has not been used in the twelve months preceding its expiration date. Cards will not be renewed if the holder notifies Europcar in writing about the cancellation at least two months before the expiration date. Europcar reserves the right not to renew the card without justification or prior notice.
Registration and Dissemination of Information
1.9 / To obtain a Europcar card and enjoy the associated services, it is mandatory to fill out the requested information in the application form. Fields marked with an asterisk (*) are not mandatory. The collected information is stored in a computerized database. The cardholder can consult this database at any time to review and/or correct their personal data. Europcar is authorized, with the explicit consent of the holder, to provide data about the holder to third parties. In any case, this information disclosure will be subject to local regulations regarding data stored in computer systems. Europcar may also provide information about the cardholder within the Europcar network worldwide and to third parties solely for vehicle rental service purposes. The information provided in the application form may be disclosed for debt collection purposes.
1.10 / To consult or rectify stored information or object to the clause of personal data transfer to third parties, the cardholder must notify Europcar in writing at the Europcar Central Office in their country of residence. Please refer to the list at
www.europcar.com.
1.11.
Modification of Specific Conditions for the Europcar Privilege Loyalty Program
Europcar may modify the specific conditions of the Privilege Program if deemed necessary, notifying the Privilege Program Member in writing at least ninety (90) days in advance. In this case, the Administrator will inform each Privilege Program Member via email and specify the effective date of the modification of the Program conditions. In any case, each member will benefit from the advantages related to their Privilege card until its expiration date.

2. General Conditions for Europcar Charge Cards
The Card
2.1 / The Europcar charge card (hereinafter referred to as the "Charge Card") is not a credit or check guarantee card. It is a card issued free of charge.
2.2 / The Charge Card is the exclusive property of Europcar, and therefore, the holder must return it to the issuing entity when required. Europcar reserves the right to withdraw the Charge Card or request it in writing from its holder without justification or prior notice.
2.3 / In cases where local laws regarding the use of the Charge Card outside the country of issuance apply, these local regulations will govern both for the cardholder and Europcar offices. A full list of the company's office network can be requested at any Europcar office.
2.4 / Europcar reserves the right to reject the Charge Card as a payment method for certain specific products and/or vehicle categories, according to Europcar's policy based on seasonality, country, or rental office. This policy is subject to changes without prior notice.
2.5 / The Charge Card can be issued in the name of an individual or a legal entity (the holder) once Europcar has verified commercial reports, approved the credit, and opened the corresponding account. The credit can be canceled at any time, without prior notification or justification. Corporate cards (those in which a corporate entity is the holder) must be signed on the back by the authorized responsible person before being distributed among employees, and they can only be used by authorized users, with the corporate entity designating the holder's validity with their signature.
Payments
2.6 / Europcar will send invoices to the cardholder in accordance with the applicable Europcar General Rental Terms and Conditions, which will be the only ones determining the amount and payment date. Signing Europcar’s Credit Application and/or signing the Charge Card and/or using the Europcar card implies full acceptance of the Europcar General Rental Terms and Conditions.
2.7 / Credit conditions will be as stated in Europcar's Credit Application and according to the invoice payment date. Payment will be made according to the method agreed with Europcar in the previously completed credit application form. If no payment method is specified, payment will be made by commercial check against the account specified in the completed credit application form.
2.8 / Invoices and payments will be made in the local currency of the cardholder's country of residence. Charges for rentals abroad will be converted to the local currency based on the exchange rate in effect on the invoicing date. The exchange rate will be set by Europcar and may vary depending on the period and country. For rentals in euro zone countries by euro zone residents, the conversion to the cardholder’s national currency will be calculated according to the European Commission's rules.
2.9 / In the event of non-payment of any rental invoice or other charges, the cardholder or any other responsible person will be liable for any costs incurred by Europcar to enforce its rights over the holder and any expenses resulting from the non-payment of the invoice by the holder under this contract.
2.10 / If, at any time, the cardholder fails to make payment by the due date, the period extending from the due date until the payment is made in full will be divided into successive periods, the duration of which will be determined by Europcar, and the cardholder will pay interest on the unpaid amount during each of these periods (before the corresponding judgment is issued). These interests, which the cardholder can request from Europcar, will accrue daily based on a 365-day year and the actual number of days elapsed. The interest rate may vary from country to country or period to period based on local regulations and the applicable terms and conditions of credit.
Indemnification
2.11 / If a Charge Card is issued in the name of a company or any other legal entity, or in the name of an individual, and the holder does not pay any invoice corresponding to rentals and other charges in accordance with the applicable payment conditions, or if the holder does not fulfill any obligation derived from a rental contract made with the issued card, that individual will indemnify Europcar for the non-payment or default.
2.12 / The cardholder accepts Europcar’s right to modify rental charges at any time (except for rentals already in progress or reserved), and the cardholder assumes any responsibility arising from the modification. The cardholder, upon Europcar's request, will indemnify and compensate Europcar for any costs, expenses, losses, claims, legal actions, damages, and harm suffered by the cardholder or Europcar in relation to the invoice.
Changes to Information on the Charge Card
2.13 / If the information on the Charge Card or the previously submitted credit application form is incorrect, or if such information changes at any time during the card's validity period, the cardholder will immediately notify Europcar in writing. If deemed necessary, Europcar will issue a new card to replace the previous one and update the cardholder’s records as required, and may cancel credit lines without prior notice and without justification. In any case, the cardholder will ensure the card is not used if the financial situation of the legal entity prevents it from making payments for any reason.
Additional Cards
2.14 / The cardholder may request additional Charge Cards in writing from Europcar, usually via the form provided by Europcar, for individuals nominated by the holder who work for them, which Europcar is authorized to issue. Once the additional Charge Cards are issued, the cardholder will be responsible for their use, as if they had used them themselves. These cards will be governed by these general conditions unless otherwise specified in writing at the time of their issuance.
2.15 If the additional cardholder ceases to work for the cardholder or no longer meets the necessary conditions to obtain credit, the cardholder must immediately inform Europcar in writing by destroying the additional card or returning it urgently to Europcar. Nevertheless, the cardholder will remain responsible for all rentals and charges arising from any rental agreement entered into by any of the persons authorized to use an additional charge card.
Request for Invoice Information
2.16 If the cardholder believes that an invoice is incorrect or wishes to receive additional information about a specific transaction reflected on the invoice, the cardholder must submit a written request to Europcar's Customer Service Department at the company’s headquarters in the corresponding country, within fifteen (15) days from the date of the invoice in question and/or within seven (7) days after the date of the next monthly statement. Once this request is received, Europcar may, at its discretion, notify the cardholder in writing that they are not obliged to pay the disputed amount on the corresponding invoice while all inquiries deemed necessary by Europcar are made regarding the request. In any case, the cardholder will still be obligated to pay the items on the invoice that have not been disputed or clarified.
Modification of Terms and Conditions
2.17 The terms and conditions applicable to the use of the card may be modified with prior notice to the Customer.
3. General Conditions of the Privilege Express Service
The following General Conditions of the Privilege Express Service apply from October 2010:
3.1 Objective of the Privilege Express Service
The objective of the "Privilege" service (Privilege Express Service) is to offer the Customer a faster service when picking up the rental vehicle:
The rental contract is pre-printed according to the reservation conditions.
The Customer will have immediate access to the key for the reserved vehicle.
If the Customer arrives late to pick up the vehicle, it will remain available for 2 hours after the scheduled pick-up time.
3.2 Registration
The following information is provided to the Customer:
It is necessary to complete a registration form. The registration in the Privilege Express Service and the corresponding Master Rental Agreement (if any) are free of charge for the Customer. Once the Customer's registration request is accepted by Europcar, Europcar will enter or update the Customer's personal details in their computer system. Europcar will assign the Customer a driver identification number (Europcar ID number). If the person is already an existing customer of Europcar, their Europcar ID number will be confirmed. This Europcar ID number will be embossed on the Europcar Privilege Card provided to the Customer.
3.3 Applicable Conditions
The Privilege Express Service is governed by:
(i) the General Conditions for all Europcar cards;
(ii) the General Conditions for Europcar charge cards; and
(iii) the General Conditions for the Privilege Express Service.
Europcar may make modifications, amendments, cancellations, or additions to these conditions at any time, which will be notified to the Customer accordingly. Within the limits allowed by applicable law, these modifications, amendments, cancellations, or additions will be considered approved by the Customer if they proceed with a rental using the Privilege Express Service after the effective date of the changes.
3.4 Requirements for the Privilege Express Service
The Customer must hold and present a valid driving license in the country where the rental takes place. The license must have been issued by the relevant authorities and be at least 12 months old at the start date of the rental. If the regular driving license is written in a language different from the language of the country where the vehicle is rented and/or uses characters not used in the rental country, an international driving permit will be required in addition to the regular driving license. Note that the international driving permit is only valid if presented alongside the regular driving license.
When renting outside the Customer's country of residence, the Customer must also present a valid identification document or passport. In European Union countries, identification documents are generally not required for Customers who are EU residents, except in specific cases, such as renting certain special or luxury vehicles. In most countries, the Customer must be at least twenty-three (23) years old (other age limits may apply depending on the Europcar rate for the type of vehicle rented) and must always hold a driving license that is at least one (1) year old.
ATTENTION: It is recommended to carefully read all the details at the time of booking. The Customer will only be entitled to the Privilege Express Service if they are the holder of a valid personal Europcar Privilege card and if the information on the registration form regarding personal or business payment methods and the Europcar ID number to which they are associated remains valid and acceptable. Europcar reserves the right to verify the accuracy of any information provided by the Customer before authorizing their registration and during any transaction made using the Privilege Express Service.
3.5 Guaranteed Reservation, Cancellation, and No-Show
To benefit from the advantages of the Privilege Express Service, the Customer must make a reservation at least two (2) hours in advance of the scheduled pick-up time, indicating their ID number. At the time of booking, both parties will confirm that the rental will be a Privilege Express Service transaction, agreeing on the office, date, time of vehicle pick-up, vehicle category, and rental duration. Europcar guarantees the vehicle category reserved or, if unavailable, will provide a vehicle of a higher category at no additional cost. With the Privilege Express Service, Europcar guarantees the reserved vehicle category for an additional two (2) hours (three (3) hours if the Customer holds an "Europcar Privilege Elite" card) from the agreed pick-up time and/or the scheduled flight or train arrival time. These extensions apply only to the rental office for which the reservation was made and last until the office closes.
ATTENTION: If the Customer does not cancel their reservation before the scheduled pick-up time and does not show up to pick up their vehicle before the office closes, Europcar may charge a "no-show" fee. Information regarding the amount of the no-show charge will be communicated at the time of booking.
3.6 Availability of the Privilege Express Service
The Privilege Express Service will be available at select major Europcar rental offices worldwide. The list of offices offering the Privilege Service can be checked during the booking process and/or at
www.europcar.com. (The list is available at the time of booking and is also provided at the end of these conditions). The Privilege Express Service will be identified with a Privilege Express sign at the counters of participating rental offices. Europcar may change the list of offices, so it is recommended to check regularly which offices are available.
Before taking possession of the vehicle and leaving the rental office, the Customer must present to a Europcar employee their:
Valid and current driving license,
Valid passport or national identity document if not an EU resident renting a vehicle in the EU, EXCEPT for vehicle categories starting with "X" (Special) or "L" (Luxury). In all other cases, foreign drivers will be required to present a valid passport.
ATTENTION: The Privilege Express Service is NOT available for:
Trucks and vehicles in the "Special" category (codes starting with "X"),
Additional drivers and rentals exceeding 28 days,
Any optional equipment that is not standard for the car,
Rentals for which the car has already been fully prepaid.
However, Europcar may, at the Customer's request, waive the above restrictions and grant the Privilege Express Service to the Customer. The booking agent will provide the Customer with all the necessary information regarding the availability of the Privilege Express Service at the time of booking.
ATTENTION: If for any reason the availability of the Privilege Express Service cannot be confirmed at the time of booking or if it cannot be provided to the Customer at the time of vehicle pick-up, the rental transaction will proceed according to the standard Europcar rental procedures for customers not using the Privilege Express Service. Europcar will take all precautions and do everything within its power to avoid this situation, and to the extent permitted by law, will not be responsible for any loss, damage, or expense incurred due to the failure to provide the Privilege Express Service. Please note that Europcar reserves the right to suspend, modify, or terminate the Privilege Express Service at any time by notifying the Customer in writing.
3.7 Payment Methods
3.7.1 Accepted Payment Methods
The payment methods registered against the pre-printed rental agreement will, by default, be the valid and preferred payment methods specified by the Customer in the registration form, excluding any other payment methods. If the Customer lists several payment methods in the registration form, the first will be the Europcar charge card or the preferred Credit/Registration card, or if none is specified, the first valid credit card selected. The Customer may provide payment details for other personal payment cards for a specific booking. The Customer must then present this new payment method at the time of rental for confirmation and signature.
Travel vouchers, reward certificates, promotional coupons, and similar items can only be used for rentals via the Privilege Express Service with Europcar, subject to prior approval or confirmation at the time of booking.
3.7.2 Credit Card Processing
When payment is made by credit card, authorization will be required before the rental begins. The minimum authorization amount should cover at least the estimated rental and any other relevant charges. This amount is not charged; it is held on the account until the final rental amount is charged. Upon vehicle return, the billed amount will be charged to the provided credit card unless the Customer presents another payment method. Europcar offers a currency conversion service for "Visa" and "MasterCard" cardholders: By accepting these conditions, when at least one of the parties is domiciled in a country where the euro, British pound, or Swiss franc is not used, the Customer agrees that the rental agreement will be prepared according to the following rule:
3.8 TERMINATION
Termination due to expiration of the payment method
The Privilege Express Service will be terminated upon the expiration of the payment method associated with the Customer’s profile, unless the Customer has submitted a duly completed data update form to Europcar, either by mail or fax, before the expiration date of said payment method. The data update forms are available at the Europcar headquarters in the Customer’s country of residence or at
www.europcar.com.
Termination for "convenience"
Both Europcar and the Customer have the right to terminate the enrollment in the Privilege Express Service at their discretion, with prior written notice to the other party at least one (1) month in advance, addressed to the relevant address listed in the enrollment form (or to another address that has been notified later).
Termination for breach
Europcar is authorized to immediately terminate the enrollment in the Privilege Express Service in the event of a breach of any obligation by the Customer or if any information provided by the Customer in the enrollment form or by any other means is, or is proven to be, inaccurate, incomplete, erroneous, or misleading.
Termination after card theft or loss
In the event of theft or loss of the card, the Customer must inform Europcar by any means. Once Europcar is informed of the theft or loss, it will block the use of the card and terminate the contract. At the same time, Europcar will provide the Customer with a new card based on the terms and conditions previously accepted.
3.9 FORCE MAJEURE
No party will be held liable in the event of Force Majeure. Any irresistible, unpredictable, and external event to the parties, as defined in Article 1148 of the French Civil Code, shall be considered a case of Force Majeure.
3.10 APPLICABLE LAW AND COMPETENT COURT
These Terms and Conditions shall be interpreted in accordance with French law and can be consulted at
www.europcar.com, hosted in French territory. French law is applicable, and the courts of Paris shall have jurisdiction to the extent provided in Article 5-1 of the Rome Convention of 1980 and Articles 14 and 15 of the Brussels Convention.
4. Special Terms of the Europcar Rental Master Agreement and Privilege Express Terminals Worldwide
The Europcar Privilege Express Rental Master Agreement is available at all Privilege offices – including Privilege Express Terminals – unless expressly prohibited by local regulations in the delivery country (such as in Portugal or South Africa).
4.1 DEFINITION OF THE PRIVILEGE RENTAL MASTER AGREEMENT
Within this service, and as a complement to the previous General Terms and Conditions, the Customer does not need to sign the pre-printed Rental Agreement. Once confirmed by the Europcar booking agent, the Customer may collect the vehicle keys at the Europcar office by presenting the corresponding valid driving license.
4.2 REQUIREMENTS FOR THE PRIVILEGE RENTAL MASTER AGREEMENT
By signing the registration form and accepting the Privilege Rental Master Agreement in accordance with the Global Rental Terms, the Customer is deemed to have read, understood, and accepted the provisions applicable to rentals processed through the Privilege Rental Master Agreement, whether at an office or through an Europcar Privilege Express Terminal. (Please consult the specific conditions for each country in section V).
When leaving Europcar rental facilities, the Customer acknowledges having received and accepted the Europcar Privilege Express Rental Agreement completed for that rental.
4.3 CHARGES FOR EACH RENTAL
The Customer’s signature on the registration form of the Privilege Rental Master Agreement authorizes Europcar to charge them the total cost of each rental through one of the payment methods specified in that form, and to collect the amount of any claims arising from the contract signed through the Privilege Express Terminal or Office, including the charge for any deductibles in the event of an accident caused by the Customer. The total cost of each rental will be determined in accordance with Section 5.5. Terms and Conditions ** PRIVILEGE EXPRESS SERVICE **
4.4 REPRESENTATIONS, WARRANTIES, AND INDEMNIFICATION BY THE CUSTOMER
The Customer agrees, within the limits allowed by applicable law, to indemnify Europcar and hold them harmless from any losses and claims arising from any rental agreement made with the Europcar card or a credit card accepted by Europcar under the Privilege Rental Master Agreement signed by the Customer in violation of the conditions associated with Membership status, or by an unauthorized Customer or third party who has used the Europcar Privilege card or a credit card linked to it.
The Customer will not be liable for such losses if, in the case of loss of the Europcar card, the Customer notified Europcar in a timely manner so that the card could be blocked. Please refer to the General Terms of all Europcar cards.
4.5 APPLICABLE LAW AND COMPETENT COURT
These Terms and Conditions shall be interpreted in accordance with French law and can be consulted at
www.europcar.com, hosted in French territory. French law is applicable, and the courts of Paris shall have jurisdiction to the extent provided in Article 5-1 of the Rome Convention of 1980 and Articles 14 and 15 of the Brussels Convention.
5. Privilege Rental Conditions Worldwide and Specific Country Conditions (Applicable to the Master Rental Agreement)
The Privilege Rental Conditions worldwide apply starting from October 2010.
PRIVILEGE EXPRESS RENTAL CONDITIONS
THE FOLLOWING PRIVILEGE EXPRESS RENTAL CONDITIONS APPLY TO RENTALS BASED ON THE COUNTRY IN WHICH THE RENTAL TAKES PLACE; THESE CONDITIONS ARE COMPLEMENTED WITH OTHER SPECIFIC RENTAL CONDITIONS. PLEASE NOTE THAT THE SPECIFIC RENTAL CONDITIONS THAT MAY BE APPLICABLE TO THE RENTAL ARE INCLUDED AT THE END OF THIS DOCUMENT, IN THE SECTION "SPECIFIC COUNTRY RENTAL CONDITIONS."
Europcar recommends carefully reading both the Privilege Rental Conditions and the specific rental conditions for each country applicable to the rental. Europcar also recommends confirming with the office the specific conditions that may apply at the time of the rental.
5.1 DEFINITIONS AND GENERAL PRINCIPLES
"The Customer" refers to the main driver, the one who signed the registration form and is authorized to drive the vehicle.
"Europcar" refers to the subsidiary or franchise of EUROPCAR mentioned in the pre-printed rental agreement.
"Vehicle" refers to the car rented by Europcar to the Tenant during the duration of the pre-printed rental agreement and includes all the parts and accessories with which the vehicle is equipped at the beginning of the rental.
"Damage" refers to any damage affecting the vehicle (including windows, headlights, and mirrors) and any damage to third-party property, when relevant.
5.2 PRE-REQUISITES: What does the CUSTOMER need to DO to rent a vehicle?
The rental requirements are available in the General Terms and Conditions of the Privilege Express Service, in section 3.2 "Requirements for the Privilege Express Service."
5.3 THE VEHICLE: CONDITION, USE, MAINTENANCE, MECHANICAL ISSUES AND BREAKDOWN ASSISTANCE
5.3.1 Vehicle Condition.
A description of the vehicle's condition will be provided at the same time as the Rental Agreement.
Before taking the vehicle, it is necessary to check its condition. Any apparent defect on the vehicle that is not previously indicated in the form must be immediately reported to the Europcar employee at the counter, in order to proceed with a joint inspection of the vehicle. In such cases, any changes should be noted on the document, which must be signed by both parties. If the modified document has not been signed by both parties, the condition of the vehicle will be considered as initially indicated along with the rental agreement, and under the applicable legislation, it will be deemed that the customer received the vehicle in proper working condition. The customer must return the vehicle in the same condition in which it was received at the start of the rental. The customer is responsible for any repair or reconditioning costs that may have been made, and these will be added to the total rental cost, as specified in the "Summary of Optional Guarantees," listed further below.
5.3.2 Vehicle Use
The vehicle must not be driven by anyone other than the Customer, and only as long as the Customer’s ability to drive is not impaired in any way due to physical or mental incapacity or restricted by law. If the Customer wishes to drive the vehicle outside of the country of pick-up, the Customer is obliged to verify that the Terms and Conditions of Europcar applicable to the country they are traveling through allow it and, if necessary, obtain prior written consent from Europcar. Depending on the country of vehicle pick-up, certain restrictions may apply regarding:
the transport of the vehicle by train, boat, ferry, or similar modes of transport;
the transport of the vehicle from a mainland region to an island;
crossing borders with certain types of vehicles.
The Customer must carry out the necessary checks at the time of booking. The details of the applicable restrictions are available in the "Country-Specific Rental Conditions" section and will be provided at the same time as the Rental Agreement.
The Customer must take care of the vehicle, maintain it in good condition, pay any fines they are responsible for, and reimburse Europcar for any damage caused to the vehicle and any expenses incurred by Europcar due to such damage.
The vehicle will be provided with a full fuel tank. The Customer agrees to refuel it with the same type of fuel. The costs of fuel and refueling services will be agreed upon according to the conditions stated at the office if the vehicle is not returned with a full tank. Europcar recommends that the Customer carefully reads this information available at the Europcar office. The Customer is responsible for all taxes, fees, fines, and penalties that arise in connection with the use of the vehicle and are charged to Europcar, unless these are due to a breach by Europcar.
During the rental period, the Customer must perform regular checks (engine oil level, tire pressure, etc.) and must adhere to the maintenance cycle specified in the vehicle's maintenance guide, if available. When parking the vehicle, even for a short period, the Customer agrees to lock it and use the alarm and/or immobilizer system. Additionally, the Customer must never leave the vehicle unattended with the keys in it. Failure to return the keys will invalidate the theft coverage.
The Customer agrees to use the vehicle responsibly and only for its intended purposes. For a vehicle, this primarily involves transporting passengers, excluding sub-renting or transporting people for profit. Specifically, the Customer must not use the vehicle under any of the following circumstances or for any of the following purposes:
driving under the influence of alcohol, narcotics, or any kind of drugs,
transporting flammable or dangerous goods, as well as toxic, corrosive, radioactive, or other harmful substances,
transporting any items that, due to their odor or condition, may damage the vehicle or cause Europcar to lose time or money before it can rent the vehicle again,
transporting live animals (except for pets),
using a roof rack, luggage carrier, or similar, unless provided by Europcar,
sub-renting the vehicle to third parties,
transporting passengers for a fee,
participating in rallies, competitions, or trials, wherever they are held,
providing driving lessons,
pushing or towing another vehicle (except for vehicles equipped by Europcar with a tow hook; maximum load 1,000 kg), or exceeding the authorized load capacity,
traveling on unpaved roads or roads in such poor condition that they could damage the tires or underside of the vehicle,
intentionally committing a crime or failing to obey traffic laws,
allowing any items or luggage transported in the vehicle, including packaging and storage materials, to damage the vehicle or expose occupants to any risk, in any way violating the highway code, traffic laws, or other laws.
THE CUSTOMER WILL BE RESPONSIBLE FOR ANY OFFENSE COMMITTED DURING THE RENTAL PERIOD
that is related to the use of the Vehicle, as if they were the owner. The Customer agrees that Europcar may provide their personal data to the Police or any official body that requests it, if doing so complies with the data protection laws of the rental country.
5.3.3 Maintenance / Mechanical Problems
The Vehicle is provided with a full set of tires in good condition. If any of them are damaged due to any reason other than normal wear and tear, the Customer must replace it with another tire of the same size, type, and condition, at their own expense.
If any dashboard warning lights come on, indicating a mechanical problem, or if the Customer notices any other signs that may indicate the presence of a mechanical problem in the Vehicle, they must stop the Vehicle. If the odometer stops working for any reason other than a technical fault, the Customer must pay a mileage charge according to the rates in the rental country.
At the beginning of the rental, the Vehicle will be suitable for driving and for normal use. If this is not the case, or if during the rental it becomes unsuitable for driving or cannot withstand normal use due to a mechanical failure or an accident, the Customer must inform a Europcar office or call the emergency phone number found in the rental contract folder. Europcar may choose either to replace the Vehicle with another or accept that necessary repairs be made to it. In the latter case, repairs can only be made after oral or written confirmation from Europcar, in accordance with the instructions provided by Europcar and with prior acceptance by Europcar of the cost estimate. The Customer must be able to provide the name and office name of Europcar that accepts the repairs.
Notwithstanding any issue of liability, repair costs may be charged directly to Europcar. Otherwise, Europcar reserves the right to ask for the defective parts and paid invoices to be sent. Any repairs made without Europcar’s order will not be reimbursed. When returning the vehicle, the Customer must inform Europcar, or one of its agents, about all accidents, damage, or breakdowns, even those that have been repaired. The Customer will be responsible to Europcar for any damage.
In any case, neither Europcar nor its advisors, directors, or employees will be responsible to the Customer for any loss or damage (including, but not limited to, loss of profit or earnings, etc.); nor, to the extent permitted by law, will they be responsible for indirect consequential damages, whether their liability is contractual or tortious.
5.3.4 Breakdown Assistance
During the rental period, as agreed with Europcar, the Customer is entitled to the provision, at no additional cost, of a Breakdown Assistance Service. If necessary, the Customer can contact this service by calling the phone number provided in the rental contract folder, on the windshield, or on the keychain.
To benefit from this coverage, in case of a breakdown, the Customer must contact the breakdown assistance service immediately after the incident occurs. If the Customer does not contact the Assistance Service and takes other measures or makes any payment without Europcar’s prior consent, they will not be able to claim reimbursement for the expenses. The rule of obtaining prior consent applies in all cases, not just in the case of a highway breakdown. As a result, road repair or towing costs will be reimbursed.
5.4 RENTAL PERIOD
5.4.1 Start and Calculation
The Customer agrees to return the Vehicle to Europcar at the agreed location, on the date, and at the time indicated in the rental contract.
The maximum duration of a rental contract may vary from country to country. The rental period is calculated based on indivisible 24-hour periods starting from the time the Vehicle is available. However, a delay of 30 minutes is allowed at the end of the rental period before a new 24-hour period begins. In some cases, if the Customer returns the Vehicle to any other Europcar rental point different from the agreed location, return costs may apply for transporting it back to the rental office, according to the conditions available at the rental office.
Europcar strongly recommends that the Customer carefully reads this information available at the Europcar office.
5.4.2 Extension of the Original Rental Period
If the Customer wishes to extend the rental period beyond what was stipulated in the original contract but not exceeding twenty-eight (28) days, they must first contact the nearest Europcar rental office by phone to extend the rental contract (depending on the rental country, it may be necessary to visit the Europcar office in person).
The vehicle is only insured for the period mentioned in the rental contract. Unless otherwise agreed in writing with Europcar, once the rental period has been exceeded, the contracting party will be responsible for any damage to Europcar.
5.4.3 Delivery and Pickup Conditions
Europcar may confirm in writing the delivery or pickup of the vehicle at the location requested by the Customer, provided that the Customer covers the additional costs and follows the supplementary instructions of the Lessor. All this information will be provided to the Customer at the time of the reservation.
When returning the Vehicle, the Customer must, whenever possible, complete the details of: date, time of return, mileage, fuel level, as well as any other information indicated in the rental documentation folder. The Customer must also take any other actions requested by Europcar as a condition for the pickup of the Vehicle.
5.4.4 End of Rental
A rental is considered to be completed when the Vehicle and its keys have been returned to the agreed Europcar rental office counter. They must be handed over to a uniformed Europcar employee, never to parking attendants who claim or appear to be Europcar employees. If explicitly mentioned in the rental contract, the keys may be returned at the reception desk of a hotel.
In the event the Vehicle is returned without its keys, the Customer will be responsible for the cost of replacement. Europcar strongly recommends that the Customer carefully reads this information available at the Europcar office. In no case will the Lessor be responsible for any items left in the Vehicle once it has been returned.
IMPORTANT NOTE: The Customer must return the vehicle at the agreed location and within Europcar’s office hours. If the vehicle is returned outside of office hours, the rental contract will remain open, and the Customer will be responsible for any damage, fines, fees, taxes, or penalties incurred, as well as any sanctions imposed on the vehicle, as verified by Europcar.
5.4.5 In Case of Seizure, Theft, or Accident
In the event of measures by third parties, including seizure, confiscation, or transfer of the Vehicle to a municipal impound lot, the Customer must notify Europcar without delay. Europcar will then have the right to take any necessary measures to protect itself. The Customer will be responsible for all costs related to damage or loss and/or expenses associated with these actions, as well as any direct, indirect, or consequential damages (such as loss) to the Vehicle, unless it can be proven that Europcar is directly responsible for the transfer to the municipal impound lot or the confiscation of the Vehicle.
Additionally, upon notification, the rental contract may automatically terminate as soon as the legal authorities or the Customer inform Europcar.
Any use of the Vehicle that causes harm to Europcar will entitle Europcar to terminate the rental contract immediately. The Customer must return the Vehicle immediately when Europcar requests it. In the event of theft of the Vehicle, the rental contract will terminate when Europcar receives a copy of the theft report filed with the competent authorities. In the case of an accident, the rental contract will terminate when Europcar receives a copy of the accident report completed by the Customer, and when applicable, by third parties. If Europcar provides a new vehicle, the rental contract will be modified accordingly.
Furthermore, within the terms permitted by applicable law, Europcar will have no liability for any loss, theft, assault, or damage of any kind related to objects and/or belongings transported or found in the Vehicle, especially luggage and/or items.
5.5 RATES / PAYMENT CONDITIONS
5.5.1 Rates
The total charges for each rental will be determined according to the price list applicable at the time of the rental. If the Customer does not meet the preconditions for a contractual rate, the standard rate will apply.
The rates applicable to the rental, additional services, and optional coverage or insurance are those in effect on the date of issuance of the rental contract, and correspond to the characteristics the Customer initially indicated when making the reservation (vehicle type, rental duration, return office, etc.). Any modification of these characteristics will result in the application of the appropriate alternative rate. If the vehicle is not returned with a full fuel tank, a charge will be added for the missing fuel and the refueling service according to the rates in effect in the country of rental, unless the Customer has opted for the full tank option. In the case of a rental with return to a different destination, the destination return charge as shown at the counter will apply. Europcar strongly recommends that the Customer carefully reads this information available at the Europcar office.
5.6 INSURANCE
All vehicles in Europcar’s fleet are covered by mandatory third-party insurance in the event of an accident involving the Vehicle. The amounts of this liability coverage are available in the country of rental. Specifically, the Customer must comply with the rule concerning permitted destinations, as established in the "Use of the Vehicle" section above, to fully benefit from the insurance provisions.
5.7 LIABILITY FOR DAMAGE TO THE RENTAL VEHICLE OR THEFT OR MODIFICATION OF THE VEHICLE
IMPORTANT NOTE:
Within the limits allowed by applicable laws, damage to the underside of the vehicle's bodywork and/or the roof due to collisions with bridges, tunnels, hanging structures, etc., is excluded from the damage coverage unless force majeure can be proven.
5.7.1 The Customer will be liable to Europcar for any damage when renting a Vehicle entrusted to them. Therefore, in the event of theft or damage to the Vehicle, the Customer must compensate Europcar for all confirmed damages (compensation will include sums for repair costs, resale value of the Vehicle, loss of use, administrative costs, etc.). The total amount will not exceed the market value of the rented vehicle at the time of the event. This liability may be reduced if the Customer has opted for the "reduced liability" plan as defined in the next provision. Therefore, within the limits allowed by applicable laws, at the end of the rental, IN CASE OF DAMAGE OR THEFT, a mandatory charge will be applied according to the rates in effect in the country of rental. IN CASE OF MINOR DAMAGE, the charge will be applied as set out in the provisions of section 5.7.2.
Please note that any liability exemptions chosen by the Customer will be void if they fail to take proper security measures for the Vehicle, its parts, or accessories, or if they do not comply with all the vehicle usage restrictions or misuse the Vehicle.
In the event of a contract breach, the Customer will not be exempt from liability to Europcar. Consequently, the Customer will be responsible for any financial loss Europcar may suffer as a result of such a breach and for any relevant claims made by a third party. The Customer agrees to pay any amount Europcar spends to enforce these conditions.
THEREFORE, WITHIN THE LIMITS ALLOWED BY APPLICABLE LAWS, NEITHER EUROPCAR NOR ITS DIRECTORS, ADVISORS, OR EMPLOYEES WILL BE LIABLE TO THE CONTRACTING PARTY FOR ANY AMOUNT OR FOR ANY ACT, DEMAND, OR CLAIM RELATED TO ANY DIRECT, INDIRECT, CONSEQUENTIAL, OR PUNITIVE DAMAGE (SUCH AS BUSINESS LOSS OR LOSS OF PROFITS) THAT MAY ARISE OUT OF OR IN CONNECTION WITH THE RENTAL OR USE OF ANY VEHICLE, REGARDLESS OF WHETHER THE LIABILITY IS CONTRACTUAL OR NON-CONTRACTUAL. THE CUSTOMER WILL INDEMNIFY EUROPCAR AND EXEMPT IT FROM ALL CLAIMS, LIABILITIES, DAMAGES, LOSSES, OR EXPENSES THAT MAY ARISE FROM THE RENTAL AND/OR USE OF THE VEHICLE.
If the loss suffered by Europcar is subsequently reduced (e.g., recovery of the Vehicle within a maximum of 60 days, partial or total liability of a Third Party), the Customer will receive the corresponding reimbursement.
5.7.2 Minor Damages (valid only if applicable)
Both during the vehicle delivery inspection and the vehicle return inspection, Europcar, together with the Customer, will document all visible minor damages the vehicle may have, in accordance with the detailed list of minor damages and repair costs displayed at the counter, and which the Customer acknowledges having read.
During the vehicle delivery inspection, any unrepaired damage should be noted on the rental contract, duly signed by both Europcar and the Customer. Once the rental is completed, that is, during the vehicle return inspection, any new minor damage to the vehicle should be included in the rental contract. At this time, any new minor damage observed should be immediately documented, mentioned on the rental contract, and signed by both the Customer and Europcar. The damage will be charged to the Customer according to the rate displayed at the office counter. When possible, the Customer will approve the charge by signing electronically or on the corresponding paper document. Europcar will directly bill the Customer for the repair cost, including, in addition to the actual cost of the repair, administrative, immobilization, labor, and spare parts costs. The same payment conditions as those agreed upon in the vehicle rental contract will apply to all these repair costs. Europcar strongly recommends that the Customer carefully reads this information available at the Europcar office.
5.8 SUMMARY OF OPTIONAL CONTRACTUAL WARRANTIES AND/OR OPTIONAL INSURANCES OFFERED BY EUROPCAR
ALL THE WARRANTIES BELOW WILL ONLY APPLY DURING THE TERM OF THE RELEVANT RENTAL AGREEMENT, SUBJECT TO COMPLIANCE WITH THE REQUIREMENTS SET OUT IN SECTION 5.4.
The Customer acknowledges having read and understood the conditions regarding Partial Liability Exemptions ("ELL", Exoneration and/or Limitation of Liability) and/or insurances listed below, and may choose between any of these coverages by indicating it in the rental contract.
CDW (Collision Damage Waiver): Collision damage waiver in case of accident. If selected and indicated on the registration form or included in the rate, this option will exempt the Customer from liability for any damage caused to the vehicle not covered by any third party, subject to a Non-Waivable Charge. Some countries may apply exemptions to this rule.
NWC (Non-Waivable Charge): Non-waivable charge applied to the CDW coverage when the Vehicle is returned with damage, and repair costs are not covered by any third party. The amount of the Non-Waivable Charge may change periodically. Information will be provided at the time of rental.
TW / TP (Theft Waiver / Theft Protection): Theft waiver / theft protection. If selected and indicated on the registration form or included in the rate, this option will exempt the Customer from financial responsibility in the event of vehicle theft, except if caused by negligence and/or breach of contract. Merely subscribing to the CDW option does not necessarily imply this coverage is provided. The TW option may be mandatory in some countries and is recommended in many others. It may be subject to a non-waivable charge.
PAI (Personal Accident Insurance): Personal accident insurance. If selected and indicated on the registration form or included in the rate, this option provides economic compensation for the Customer and passengers (subject to the number of passengers allowed for the vehicle) in case of death or permanent disability. Compensation varies by country and may also vary depending on whether the affected person is an adult or a minor. Similarly, in case of partial disability, the compensation may be lower or nonexistent if the disability percentage is below a certain threshold.
In some countries, it may also cover medical assistance costs.
The coverage offered by the PAI option is provided by an insurance company. The terms and conditions governing this coverage are included in the corresponding general policy, which is available for consultation. By accepting the PAI coverage, the Customer accepts the conditions of the general policy.
5.9 APPLICABLE LAW AND COMPETENT COURT
These Terms and Conditions will be interpreted according to French Law and can be consulted at
www.europcar.com, hosted in French territory. French law applies, and the courts of Paris will have jurisdiction as stipulated in Article 5-1 of the 1980 Rome Convention and Articles 14 and 15 of the Brussels Convention.
5.10 DATA PROTECTION LAW
Please note that during the booking and rental processes, Europcar collects certain personal data. It is mandatory to provide all the requested information; if any of this information is missing, unfortunately, Europcar will not be able to ensure the correctness of the booking and/or rental.
In accordance with the "EU Data Protection Directive" (95/46/EC), you have the right to access, modify, or delete the data collected and stored by Europcar at any time by contacting Europcar’s data center in your country of residence. Europcar is an international company with data centers in various countries. To facilitate booking and/or rental processes, Europcar may need to transfer personal data to its data centers worldwide or to franchisees or external partners to complete or enhance car rental services. If the data protection level in a country is not adequate, Europcar will ensure that the data transferred to that country is sufficiently protected.
5.11 SPECIFIC RENTAL CONDITIONS BY COUNTRIES
NOTE: The following provisions apply to all rentals from Europcar or franchises located in:
5.11.1 AUSTRALIA:
(3.7.2 Credit Card Processing): At the time of the rental, a deposit corresponding to the estimated rental price will be charged to the credit card. Any difference must be paid upon vehicle return.
(5.3.3 Maintenance / Mechanical Issues): Mileage charges, if any, will be calculated based on the vehicle's odometer. If the vehicle's odometer is not functioning or has been tampered with, mileage charges, if any, will be based on the amount, in Australian dollars, corresponding to 400 km per day at the applicable rate per kilometer.
(5.4.5 In case of confiscation, theft, or accident): If the vehicle or any of its parts or accessories is stolen, damaged, involved in a criminal act, or involved in an accident resulting in injury, the Customer must immediately contact the local police to report the incident. The Customer must call the rental office where the vehicle was rented within 24 hours to report the accident and provide Europcar with the police details and any other requested information. The Customer must also call the rental office within 24 hours to report any other accident in which the vehicle was damaged. If the vehicle is unsafe or unfit for the road after any incident, it must not be used. The Customer must always:
Note the police report number and the name of the officer in charge if the police were involved;
Note the names, addresses, and phone numbers of all witnesses where relevant;
Avoid admitting fault for the accident;
Send Europcar all papers and documents received regarding the accident or damages (including copies of any court documents and legal paperwork);
Complete and sign Europcar's Motor Vehicle Accident Report Form and send it to Europcar within 48 hours of the loss or damage; otherwise, the insurers may refuse to consider the claim;
Cooperate fully with Europcar, insurers, and any other party designated by Europcar or the insurers.
The Customer must authorize Europcar or the insurers, or anyone designated by the insurers, to take any legal action or enforce their rights on the Customer's behalf. The Customer must do whatever Europcar or the insurers reasonably consider necessary to help Europcar or the insurers enforce Europcar's or the insurers' rights for the vehicle's loss or damage, its parts, and accessories while the Customer had rented it. If the Customer receives any money related to a loss or damage of the vehicle and/or its parts and accessories, they must pay it to Europcar and, until this is done, hold it in trust for Europcar.
(5.5.2 Payment Terms): If the Customer has not made payment by the due date indicated on the invoice, Europcar will charge an annual interest of 15% on any amounts owed by the Customer.
(5.6 INSURANCE): All vehicles are covered by a Third-Party Liability insurance policy for Motor Vehicles up to a maximum of 100,000 Australian dollars. If the Customer breaches any of the Rental Conditions of this Agreement or if the loss results from immersion in water or failure to return the keys if the vehicle was stolen, the Customer will be fully liable for all damages to the Vehicle and Third Parties, and the optional coverage will not apply. Europcar does not provide any guarantees beyond those implied by the Trade Practices Act of 1974.
(5.8 SUMMARY OF OPTIONAL CONTRACTUAL WARRANTIES AND/OR OPTIONAL INSURANCES OFFERED BY EUROPCAR): The TW/TP policy is not applicable in Australia.
5.11.2 BELGIUM:
(5.3.2 Use of the Vehicle): When traveling in Italy, the Customer will be fully responsible in case of theft or modification of vehicles in categories ranging from Full-size, Premium, Luxury, Special, Convertible cars, and SDMR, without the possibility of purchasing theft insurance. No models from the brands Mercedes, Audi, and BMW are authorized to be driven from Belgium to Italy.
(5.4.5 In case of confiscation, theft, or accident): The Customer agrees to inform Europcar within 24 hours of any accident, theft, or fire involving the vehicle, and to immediately notify the police of any bodily injury, theft, vandalism, or suspicious fire. In case of vehicle confiscation as a result of any offense committed by the Renter, Europcar reserves the right to charge the Customer for all expenses incurred in recovering the vehicle.
(5.9 APPLICABLE LAW AND COMPETENT COURT): These Conditions will be interpreted according to the law of the country where Europcar is located, and both Europcar and the Renter will submit to the exclusive jurisdiction of the Brussels courts.
5.11.3 FRANCE:
(5.6 INSURANCE): All vehicles are covered by a Third-Party Liability insurance policy for Motor Vehicles as required by law. They also benefit from Roadside Assistance coverage. The Customer also has the option to purchase optional Personal Accident Insurance and Luggage Coverage.
The terms and limitations applicable to mandatory and optional insurance, as well as Roadside Assistance coverage, are available in the Insurance and Assistance brochure, which is attached to the rental contract.
(5.10 DATA PROTECTION LAW): Law of January 6, 1978: To exercise the right of access or modification, or to object to the communication of data relating to the Renter to external commercial entities, the Renter must contact in writing: Europcar France BP 19 78184 Saint Quentin en Yvelines Cedex.
5.11.4 TERMINAL PRIVILEGE EXPRESS OF GERMANY:
PRIVILEGE EXPRESS TERMINAL (except in Portugal). Privilege Express terminals are installed in certain Europcar Privilege Express rental offices in Germany and will be extended to other countries later. The list is available at the time of booking on
www.europcar.com and also appears at the end of these conditions.
The Customer must check the availability of the Privilege Express Terminal with Europcar at the time of booking. If a Terminal is unavailable, the Privilege Matrix Rental Agreement will be processed at the Europcar counter. As a prerequisite for a rental at the Privilege Express Terminal, the Customer must possess a valid driver's license at the time of rental. Before the first rental at the Privilege Express Terminal, the Customer must show their driver's license at the Europcar counter. The Customer will confirm that the status of their driver's license has not changed for each subsequent rental. The Customer must immediately notify Europcar of any changes in the status of their driver's license and/or personal details. If the Customer violates any of the obligations above, they will be responsible to Europcar for all damages caused by this and will hold Europcar harmless from any claims by third parties, especially from payment claims from liability insurers. The rental agreement printed by the Privilege Express Terminal will become effective when the card inserted in the terminal is used, when the keys to the vehicle intended for the rental are handed over as provided by the Privilege Express Terminal, at the agreed rate for that vehicle, and for the rental period validated by the Privilege Express Terminal.
Additionally, Europcar's General Rental Conditions, valid at the time the rental agreement is made, will apply.
The Customer authorizes Europcar to collect all amounts due as a result of the rental agreement, including their own risk in the case of an accident caused by them or their omission, through the card used for the transaction at the Privilege Express Terminal.
The Customer agrees to pay all claims by Europcar resulting from the rental agreement made through the Privilege Express Terminal, which was subscribed using an Europcar card or a credit card accepted by Europcar, regardless of whether the Customer themselves or an unauthorized third party used the card to make a rental through the Privilege Express Terminal. The Customer will not be liable for costs incurred due to improper use of the Europcar Card if they have promptly reported the loss to Europcar, ensuring that the Europcar Card has been blocked before any improper use.
5.11.5 GERMANY:
(3.7.2 Credit Card Processing): At the time of rental, a deposit corresponding to the estimated rental price will be charged to the credit card. The difference must be paid upon vehicle return. If payment is deferred according to the contractual agreement, it will be due 14 days after the vehicle is returned. After delays have started, a fee of €2.50 will be charged for each reminder. In case of late payment, the late payment interest will be the European Central Bank discount rate plus 3 percentage points, with a minimum annual interest of 6%. The Customer is entitled to prove that damages due to the delays were less. If delays incurred by the Customer require hiring a debt collection agency, the Customer will be responsible for the costs associated with it.
(5.3.3 Maintenance / Mechanical Issues): The Customer is required, at the expiration of the rental period, to return the vehicle to the agreed Europcar office during business hours. Mileage will be calculated according to the odometer reading from the rental office to the return office.
(5.4.5 In case of confiscation, theft, or accident): In case of an accident, fire, theft, damage caused by animals, or other damage, the Customer must notify the police immediately after the incident occurs. This also applies in case of accidents caused by the driver without involving third parties. Claims against the Customer will not be accepted, and the Customer must immediately send a detailed written report to Europcar, including a diagram, even in cases of minor damage. The accident report must include, especially, the names and addresses of the people involved and any witnesses, as well as the license plates of the vehicles involved.
(5.9 APPLICABLE LAW AND COMPETENT COURT): For all disputes arising from or related to this contract, it is agreed that Hamburg will be the appropriate jurisdiction forum if:
a. The Customer does not have a general jurisdiction forum in the country or relocates their residence or habitual domicile abroad after the contract ends or if their residence or habitual domicile is unknown at the time the claim is filed.
b. If the Customer is a fully qualified retailer or a person comparable under Section 38 (1) of the German Civil Code.
5.11.6 ITALY:
(5.4.5 In case of confiscation, theft, or accident): In case of theft or attempted theft, the Customer agrees to immediately report it to the competent authority and provide the original document containing the report to the Lessor within 24 hours. The liability restriction or exclusion (TW, CDW) will not apply in cases of fraud or gross negligence. Also, the contract known as TW will not apply to (and thus will not exclude) the Customer's liability for any full or partial theft occurring in the regions of Campania and Puglia, which are considered high-risk areas for theft. If the Customer fails to provide the original report, the liability restriction or exclusion (TW, CDW) provided in the contract will not apply. In case the Vehicle is stolen and the Customer fails to return the keys, Europcar may require payment of an amount equivalent to 180 days of rental (current "Airport drive" public fee) and the cost of a full fuel deposit, which in any case will not exceed the vehicle's market value at the time of the incident.
The exclusion of liability for damages to the rented vehicle (known as "CDW") does not apply to punctures, damages caused by tilting of wheels, tarpaulins, and tires, except for simple punctures, as well as damages caused by improper refueling.
(5.5.2 Payment Terms): If payment has not been made by the due date on the invoice, the Customer will be responsible, once a formal notice has been sent, for paying interest at the official annual interest rate of the European Central Bank of the country where Europcar's headquarters are located, plus 5 percentage points.
(5.9 APPLICABLE LAW AND COMPETENT COURT):
This contract is governed by Italian law. Any dispute arising in connection with the validity, interpretation, performance, or resolution of this contract will be subject to the exclusive jurisdiction of the Court of Rome.
(5.10 DATA PROTECTION LAW)
5.11.8 POLAND:
(5.4.5 In case of confiscation, theft, or accident). In the event of an accident or theft, the Customer must immediately inform the Police. The Customer shall not have the right to accept claims from the other party. The Customer must inform Europcar without delay about all damage caused by fire, theft, or accident. Even when minor damages occur, the Customer is obliged to submit an accident report along with a description of the situation to Europcar.
The accident report should specify, in particular, the names and addresses of the people involved and the witnesses to the incident, as well as the license plate numbers of the vehicles involved. (5.6 INSURANCE). Europcar guarantees insurance according to the motor vehicle liability insurance policy only for those individuals using the vehicle with Europcar’s authorization. Europcar will only be responsible for losses or damages suffered by the Customer or third parties related to the Vehicle or its use if such losses or damages occur intentionally or due to gross negligence by Europcar. Europcar will not be responsible for any other incident, and the Customer will not attempt to hold Europcar liable for such claims.
5.11.9 PORTUGAL:
(3.10 APPLICABLE LAW AND COMPETENT COURT). These Terms and Conditions are issued under Portuguese law and can be consulted at
www.europcar.com, hosted in Portuguese territory. Portuguese law applies, and the Courts of Lisbon will have jurisdiction as provided in Article 17 of Council Regulation (EC) No 44/2001.
5.11.10 SPAIN:
(3.9 FORCE MAJEURE). Neither party shall be liable in the case of Force Majeure. Force Majeure is considered any irresistible, unpredictable event beyond the control of the party, as defined in the Spanish Civil Code.
(3.10 & 4.5 APPLICABLE LAW AND COMPETENT COURT). These Terms and Conditions will be interpreted in accordance with Spanish law. The Courts of Madrid shall have jurisdiction over any disputes arising or related to this contract. (5.3.2 Vehicle Use) [...] Additionally, the Customer expressly agrees, as set out in Law 17/2005 of July 19, Spain, to identify the driver of the Vehicle at any time when required by Europcar for notification of fines or administrative sanctions. If, for reasons attributable to the Customer and when requested by a competent authority, Europcar is unable to properly identify the driver of the Vehicle for notification of fines or sanctions, the Customer will be responsible for paying the fine or sanction issued to Europcar as a result of failing to identify or incorrectly identifying the driver of the Vehicle as indicated above. In such cases, Europcar will charge the Customer, who agrees, the amount of the fine or sanction in question. (5.6 INSURANCE). All vehicles in Europcar's fleet are covered by the mandatory third-party liability insurance in case of an accident involving the Vehicle, in accordance with Royal Legislative Decree 8/2004 of October 19, which approves the Law on civil liability and insurance in the circulation of motor vehicles. The coverage amounts for this liability are available in the rental country. In particular, the Customer must comply with the rules regarding allowed destinations, as stated in the previous "Vehicle Use" section, in order to fully benefit from the insurance provisions. (5.9 APPLICABLE LAW AND COMPETENT COURT). These Terms and Conditions will be interpreted in accordance with Spanish law. The Courts of Madrid will have jurisdiction over all disputes arising or related to this contract.
(5.10 DATA PROTECTION). According to the Organic Law 15/1999 on the Protection of Personal Data and Law 34/2002 on Information Society Services and Electronic Commerce, both in force, EUROPCAR IB, S.A., a company incorporated under Spanish law, with its registered office at Avda. del Partenón, 16-18, 28042 Madrid (Spain), hereby informs the Customer that their personal data will be included in a file under the responsibility of this company to provide services related to this contract, as well as: a) for statistical and promotional requirements for postal mailings and commercial information; b) for debt collection purposes; c) for quality control studies or satisfaction surveys; and d) to send information via any medium, including email or equivalent means, regarding products and services from EUROPCAR or complementary products/services. In the case of commercial communications via email or equivalent means, the fact that the Customer has provided their data to EUROPCAR IB, S.A. is equivalent to giving their express consent to receive advertising materials through such means. The Customer may revoke their consent to receive the information mentioned above via email or equivalent electronic means by sending a notification to marketing.es@mail.europcar.com. This notification must include proof of the Customer's identity. EUROPCAR is an international company with data banks in various countries. To facilitate the booking and/or rental process, EUROPCAR IB, S.A. may need to transfer personal data to its data banks worldwide or to franchises or external partners to complete or improve car rental services. If the level of data protection in a country is not adequate, EUROPCAR will ensure that the data transferred to that country is sufficiently protected. In this regard, the Customer is informed and hereby authorizes EUROPCAR IB, S.A. to make the personal data available solely for the purposes stated above.
EUROPCAR IB, S.A. informs the Customer that the collection of this data is not mandatory for the services to be provided. However, failure to fill out this data may prevent EUROPCAR IB, S.A. from providing all services associated with such data, and EUROPCAR IB, S.A. will be exempt from any liability for the non-provision or incomplete provision of these services. The Customer is informed of their right to access, rectify, cancel, and oppose the data by writing to EUROPCAR IB, S.A., Avda. del Partenón, 16-18, 28042 Madrid (Spain), to the attention of the "Marketing Department". In any case, the Customer will be responsible for the authenticity of all provided data, and EUROPCAR IB, S.A. reserves the right to exclude any Customers who have provided false data from the registered services, without prejudice to any other actions the company may have the right to take according to the law.
5.11.11 SWITZERLAND:
General Data Protection:
Europcar provides car rental services to individuals and businesses. The collection, processing, and application of data allows Europcar to fulfill this goal. You are asked to provide your name, address, credit card number, email address, and phone or fax number. We use this information to confirm and process your reservation or inquiry and for internal purposes. If you rent a car, we also store additional information such as the driver's license number, its validity date, passport or identity card number, work or home address (driver identity), and certain preferences. In the case of some customer cards or business contracts between Europcar and other legal or private entities, additional information is requested and specified in the relevant contracts.
Use and Transmission of Personal Data:
Europcar uses your data for its own purposes and may partially communicate it to associated companies in Switzerland and abroad to facilitate car rentals. The data (driver's identity) required for rental contracts helps us and our affiliated companies to process the pick-up and drop-off procedures more quickly. Europcar allows public bodies to view the collected data in compliance with basic legal regulations.

5.11.12 UNITED KINGDOM:
(3.7.2 Credit Card Authorization).
The amount of the credit card authorization requested will include the estimated rental fee plus an additional £150.
(5.3.4 Breakdown Assistance).
A breakdown assistance service is provided through AA, which must be contacted immediately. This coverage provides assistance on all roads and highways in the UK.
(5.4.5 In case of confiscation, theft, or accident).
If the Vehicle or any of its parts or accessories is stolen, damaged, involved in a criminal act, or in an accident in which someone is injured, the Customer must immediately contact the local Police to report the incident. The Customer must call the rental office where the vehicle was rented within twenty-four hours and provide Europcar with the police details, as well as any other information Europcar requests. The customer must also call the rental office where the vehicle was rented within 24 hours to report any other accident in which the vehicle was damaged. If after any incident, the vehicle is unsafe or not roadworthy, it must not be used. The Customer must always:
Note the police report number and the name of the officer in charge if the Police have intervened;
Note the names, addresses, and phone numbers of all witnesses when relevant;
Avoid saying or doing anything that admits fault for the accident;
Send all paperwork and documents related to the accident or damages (including copies of any court documents and any legal papers) to Europcar;
Complete and sign a Motor Vehicle Accident Report Form from Europcar and send it to Europcar within 48 hours of the loss or damage; otherwise, the insurers may refuse to consider the claim;
Cooperate fully with Europcar, the insurers, and anyone else designated by Europcar or the insurers. The Customer must authorize Europcar or the insurers, or any other person designated by the insurers, to take legal action or enforce rights on their behalf. The Customer must do anything Europcar or the insurers deem reasonably necessary to help enforce the rights of Europcar or the insurers regarding the loss or damage of the vehicle, its parts, and accessories while the Customer had rented it. If the Customer receives any money related to the loss or damage of the vehicle and/or its parts and accessories, they must pay it to Europcar and hold it in trust for Europcar until they do so.
(5.5.2 Payment Conditions).
Value Added Tax: All Europcar prices are quoted without Value Added Tax. Europcar will charge interest on any amount the Customer fails to pay on time at an annual rate of 15%. The Customer must also pay any losses and costs that Europcar incurs while preparing, carrying out, or attempting to enforce these terms.
(5.6 INSURANCE).
The Third-Party Coverage ("TPC") provided by Europcar to the Customer (as required by the Road Traffic Act 1998) offers unlimited coverage for claims related to bodily injuries or fatalities resulting from the use of the vehicle, along with £250,000 coverage for property damage. Rates that include Europcar's Liability Insurance are only available to renters aged between 23 and 75 years (74 years and 364 days). The Customer may purchase their own comprehensive insurance but must obtain prior written approval from Europcar and provide Europcar with valid coverage notification before the rental begins. Full details are available at the main Europcar office.
(5.9 APPLICABLE LAW AND COMPETENT COURT).
The Road Traffic Act and other laws. The Customer hereby agrees to be responsible for and pay any notification or summons received regarding any violation under the Road Traffic Act during the rental period and for any other loss related to the Vehicle and its use during the rental period, which results in fixed fines and mandatory surcharges, and to indemnify Europcar for the liabilities and expenses arising from this document.
Customs and Excise Duties:
If the rented vehicle is seized by the Customs and Excise Authority and a fee must be paid, the Customer will be responsible for all costs, and the Customs and Excise Authority will charge them directly. Europcar will not be responsible for this or any associated costs.
