Australia
Credit card processing: At the time of rental, a deposit equivalent to the estimated rental price will be charged to the credit card. The difference must be paid upon returning the vehicle.
Vehicle condition: Mileage charges, if applicable, will be calculated based on the vehicle's odometer. If the vehicle's odometer is not working or has been tampered with, mileage charges, if applicable, will be calculated as the amount, in Australian dollars, corresponding to 400 km per day at the applicable per-kilometer rate.
Confiscation, theft, or accident: If the vehicle or any of its parts or accessories is stolen, damaged, subjected to a criminal act, or involved in an accident in which someone is injured, the renter must immediately contact the local police to report the incident. The renter must call the rental office where the vehicle was rented within 24 hours to report the accident and provide Europcar with the police details, as well as any other information requested by Europcar. The renter must also call the rental office where the vehicle was rented within 24 hours to report any other accident where the vehicle was damaged. If, after any incident, the vehicle is unsafe or unfit for the road, it must not be used.
The renter must always: • Note the police report number and the name of the officer if the police were involved; • Note the names, addresses, and phone numbers of all witnesses when applicable; • Avoid saying or doing anything that admits fault for the accident; • Send Europcar all papers and documents received regarding the accident or damages (including copies of any court documents and legal documents); • Complete a Europcar Motor Vehicle Accident Report Form, sign it, and send it to Europcar within 48 hours of the loss or damage; otherwise, the insurers may refuse to consider the claim; • Cooperate fully with Europcar, the insurers, and any other person designated by Europcar or the insurers.
The renter must authorize Europcar or the insurers, or any other person designated by the insurers, to take legal action or enforce rights on their behalf. The renter must do anything Europcar or the insurers reasonably require to help Europcar or the insurers enforce Europcar’s or the insurers’ rights in relation to the vehicle's loss or damage, its parts, and accessories while the vehicle was rented. If the renter receives any money related to the loss or damage of the vehicle and/or its parts and accessories, they must return it to Europcar and, until doing so, hold it in trust for Europcar.
Payment terms: If the renter fails to make payment by the date specified on the invoice, Europcar will charge an annual interest of 15% on any amount owed.
Insurance: All vehicles are covered by a Third Party Damage Liability insurance policy for Motor Vehicles up to a maximum of 100,000 Australian dollars. If the renter breaches any of the terms of this rental agreement or if the loss results from submersion in water or failure to return the keys if the vehicle was stolen, the renter will be fully responsible for all damage to the vehicle and to third parties, and optional coverage will not apply. Europcar does not offer any warranties beyond those implied by the Trade Practices Act 1974.
Contractual warranties: The TW/TP policy is not applicable in Australia.
Delivery and collection conditions: Europcar may confirm delivery or collection of the vehicle at the location requested by the renter, provided the renter covers the additional costs and follows supplementary instructions. This information will be provided to the renter at the time of the booking.
When the renter returns the vehicle, they must, if possible, complete the following details: date, return time, mileage, fuel level, and other information specified in the rental documentation folder. The renter must also take any other action requested by Europcar as a condition for the vehicle’s collection.
The renter must return the vehicle immediately if Europcar requests it. If the vehicle is not returned to Europcar upon request, the renter, by this document, authorizes Europcar to enter the renter’s premises and take all necessary actions to recover the vehicle. Any costs associated with this recovery will be charged to the renter. Europcar may recover any vehicle without notice or liability if Europcar deems such recovery necessary for its own protection.
Belgium
Vehicle use: It is not authorized to take any model from the brands Mercedes, Audi, and BMW from Belgium to Italy.
Confiscation, theft, or accident: The Renter agrees to inform Europcar within 24 hours of any accident, theft, or fire involving the vehicle and to immediately report any bodily injury, theft, vandalism, or suspected fire to the police. In the case of the vehicle being confiscated as a result of any violation committed by the Renter, Europcar reserves the right to charge the Renter for all costs incurred to recover the vehicle.
Applicable law and competent court: These terms will be interpreted in accordance with the laws of the country in which Europcar is located, and both Europcar and the Renter agree to submit to the exclusive jurisdiction of the courts of Brussels.
Germany
Credit card processing: At the time of rental, a deposit corresponding to the estimated rental price will be charged to the Renter’s credit card. The difference must be paid upon returning the vehicle. When payment is deferred as per the contractual agreement, it will be due 14 days after the vehicle has been returned. After payment delays begin, a fee of €2.50 will be charged for each reminder. If the Renter has a delayed payment, the late payment interest rate will be the European Central Bank’s discount rate plus 3 percentage points, with a minimum annual interest rate of 6%. The Renter is authorized to prove that the damages caused by the delays were less. If the delays necessitate the hiring of a debt collection agency, the Renter will be responsible for the costs incurred in relation to this.
Maintenance / Mechanical issues: The Renter is required to return the vehicle to the agreed Europcar office during business hours at the expiration of the rental period. The mileage will be calculated based on the odometer reading from the rental office to the return office. If the odometer fails, the calculation will be made according to the distance on the map plus 10%, with a minimum of 100 km per day, unless the Renter can prove they drove fewer kilometers.
Confiscation, theft, or accident: In the event of an accident, fire, theft, damage caused by animals, or other defects, the Renter must immediately notify the police. This applies to accidents caused by the driver, even if third parties are not involved. Claims against third parties should not be acknowledged. The Renter must immediately send a detailed report to Europcar, including a diagram, even for minor damages. The accident report should include the names and addresses of the people involved, any witnesses, and the license plate numbers of the vehicles involved.
Applicable law and competent court: For all disputes arising from or related to this contract, it has been agreed that Hamburg will be the appropriate jurisdiction, if: a. The Renter does not have a general jurisdiction forum in the country or moves their residence or habitual domicile abroad after the contract is completed or if their residence or habitual domicile is unknown at the time the lawsuit is filed. b. The Renter is a fully qualified retailer or a person comparable under Section 38, Subsection 1 of the German Civil Code.
Liability for damage to the rental vehicle or theft or transformation of the vehicle:
Renter’s liability: In the case of damage caused by an accident, loss, theft, improper use of the vehicle, or breach of contractual obligations outlined in the rental agreement, the Renter will be responsible for the repair costs or, in the case of total loss, the replacement value of the vehicle minus its residual value, when the Renter is responsible for the damage. Additionally, the Renter will reimburse possible consequential losses, including depreciation, towing costs, professional fees, and the total amount of administrative expenses. When liability exemption is agreed for additional charges, Europcar will exempt the Renter according to the principles of a comprehensive insurance policy, with the following excesses for vehicle damage. The excess for each damage is €340.00 for mid-range cars, but €520.00 for higher-end vehicles (e.g., BMW 523i), luxury vehicles (e.g., Audi A6), minivans (e.g., VW Sharan), and for all cases involving renters under 23 years of age (except for corporate drivers and vehicle replacements or roadside assistance rentals). For vans up to category 4, the excess is €520.00 per damage, and for category 5 (e.g., MAN 8.185) it is €800.00. A list of excesses for the respective vehicle categories can be consulted when finalizing the contract. These excesses only apply if no alternative individual agreement has been made.
The liability exemption does not release the Renter from the obligations stipulated in the rental agreement. The Renter is also fully responsible for contractual conditions, especially for losses caused by an unauthorized driver or prohibited use. If the Renter flees the scene of an accident or fails to fulfill their obligations, they will be fully responsible, unless the breach does not affect the determination of the loss. Additionally, the Renter is fully responsible if they deliberately cause the loss or if it is due to negligence, especially due to alcohol consumption or losses caused by improper loading of the vehicle or improper operations (e.g., refueling with the wrong fuel).
In relation to mandatory insurance coverage (exclusive for collision damage), the Renter is particularly responsible for damage to windows caused by wild animals, fire, and theft with an excess of €160.00 per loss. In all other cases, legal liability will apply. Otherwise, the legislative provisions remain in effect.
Europcar’s liability: Europcar will be liable to the Renter for damages, limited to ten times the agreed net rental amount, in case of non-fulfillment or impossibility of fulfilling Europcar’s obligations.
Statute of limitations: When an accident is reported to the police, any damage claim by Europcar against the Renter will only take effect once Europcar has the opportunity to examine the investigation evidence. The limitation period will start no later than six months after the vehicle has been returned. Once the investigation evidence is available, Europcar will immediately notify the Renter of the date of delivery.
Privilege Express Terminal in Germany: Privilege Express Terminals are installed in some Europcar Privilege Express rental offices in Germany and will be extended to other countries later. The list of these Privilege Express Terminals is available at the time of booking at www.europcar.com and is also listed at the end of these terms.
The Renter should check the availability of the Privilege Express Terminal with Europcar at the time of booking. If a Privilege Express Terminal is not available, the Privilege Service will be processed at the Europcar counter.
As a prerequisite for renting at the Privilege Express Terminal, the Renter must have a valid driver’s license at the time of rental. Before the first rental at the Privilege Express Terminal, the Renter must present their driver’s license at the Europcar counter. The Renter will confirm that the status of their driver’s license has not changed with each subsequent rental.
The Renter must immediately notify Europcar of any changes to their driver’s license status and/or personal details. If the Renter violates any of the obligations mentioned above, they will be liable to Europcar for any damages caused and will indemnify Europcar from any third-party claims, especially those related to payment claims from the liability insurer.
The rental agreement, as printed by the Privilege Express Terminal, will take effect for the Renter whose card is inserted in the terminal when the keys to the vehicle are handed over, according to the agreed rate for the vehicle and rental period validated by the Privilege Express Terminal.
Additionally, the General Rental Conditions of Europcar in effect at the time the rental agreement is entered into will apply.
The Renter authorizes Europcar to collect any amounts due as a result of the rental agreement, including their own risk in the event of an accident caused by them or by their omission, through the card used by the Renter for the transaction at the Privilege Express Terminal.
The Renter agrees to pay all claims from Europcar resulting from the rental agreement made through the Privilege Express Terminal, which has been subscribed using a Privilege charge card or a credit card accepted by Europcar, regardless of whether the Renter or an unauthorized third party, who was not authorized to use the card, used the card for making a rental through the Privilege Express Terminal. The Renter will not be responsible for costs incurred due to any improper use of the Europcar Privilege charge card if they have promptly reported the loss to Europcar, so that the Europcar card should have been blocked by Europcar before any improper use.
Italy:
Data Protection In accordance with Legislative Decree No. 675 of December 31, 1996, and subsequent amendments and/or additions, the Tenant has been informed in advance and explicitly agrees that: a) The personal data provided to the Lessor, or collected by the Lessor in any way during the rental period, will be processed for the purposes of this contract, as well as for statistical, promotional, postal mail, and commercial information purposes and for debt recovery purposes whenever necessary. The data will be processed by the Lessor with or without the help of automated systems for collection, recording, organization, processing, archiving, modification, selection, interconnection, blocking, communication/disclosure, cancellation, and destruction. b) The Lessor may communicate the data to companies within the Europcar group, as well as other companies performing bulk mail operations, promotional and commercial information activities, or debt recovery operations on behalf of the Europcar group. The Lessor may also use this data to allow the road network authorities or authorities responsible for later applicable regulations to collect payments for the relevant financial penalties from the Tenant. c) Article 13 of Legislative Decree No. 675/96 grants a set of specific rights to persons providing personal data, which are briefly outlined below. These rights may also be exercised by persons or associations expressly authorized in writing by the persons concerned:
  • To have the data subject to processing canceled or transformed into an anonymous format or blocked if it violates the law.
  • To update, rectify the data, and add data.
  • To certify that the aforementioned operations have been communicated to the persons to whom the data was previously sent.
  • To object to the processing of the data for justified reasons.
  • To object (exercising this right free of charge) to the processing of personal data related to the Tenant for the purpose of offering commercial information or sending advertising or sales materials or conducting market research or sending interactive commercial information.
The communication of data by the Tenant and the relevant consent for processing are provided free of charge and, in any case, are decisive for establishing and executing this rental contract. The Data Controller is Europcar Italia S.p.A., a company registered in Rome, Via del Fiume Giallo, 196, represented by its provisional legal representative. The office responsible for data processing is the company’s General Management. A detailed list of persons responsible for data processing and third parties who will receive the information can be consulted at Europcar offices.
Seizure, Theft or Accident When driving in Italy, the Tenant will be fully responsible in case of theft or conversion of vehicles in categories such as Full-size, Premium, Luxury, Special, Convertible cars, and SDMR, and will not be able to purchase theft insurance. In case of theft, and if the Tenant does not return the keys, Europcar may require payment of an amount equivalent to 180 days of rental (according to the current "Airport drive" rate) and the cost of a full fuel deposit, which, in any case, will not exceed the market value of the vehicle at the time of the incident. In case of theft or attempted theft, the Tenant agrees to immediately inform the competent authority and provide the Lessor with the original document containing the report within 24 hours. The exclusion or restriction of liability (TW, CDW) will not apply in cases of fraud or gross negligence. Moreover, the TW contract will not apply and will therefore not exclude the Tenant's liability for total or partial theft in the regions of Campania and Puglia, which are considered to have a high risk of theft. If the Tenant does not submit the original report, the liability exclusion or restriction (TW, CDW) provided in the contract will not apply. If the vehicle is stolen and the Tenant does not return the keys, Europcar may require the payment of an amount equivalent to 180 days of rental (according to the "Airport drive" rate in force) and the cost of a full fuel deposit, which will not exceed the market value of the vehicle at the time of the incident. The exclusion of liability for damage to the rented vehicle (known as "CDW") does not apply to punctures and also does not cover damage from wheel tilting, tarpaulins, and tires, except for simple punctures, as well as damage caused by incorrect refueling.
Payment Conditions If the payment is not made by the due date indicated on the invoice, the Tenant will be responsible, after receiving formal notice, for the payment of interest at the official annual interest rate of the European Central Bank in the country where Europcar is domiciled, increased by 3 percentage points.
Applicable Law and Competent Court This contract is governed by Italian law. Any disputes arising concerning the validity, interpretation, execution, or termination of this contract shall be referred to the exclusive jurisdiction of the Court of Rome.
Luxembourg:
Applicable Law and Competent Court These terms will be interpreted in accordance with Luxembourg law, and both Europcar and the Tenant submit to the exclusive jurisdiction of the courts of Luxembourg. Unless Europcar expressly agrees otherwise, the Vehicle may only be used in European Union countries.
Seizure, Theft or Accident If the Vehicle is involved in a road accident, the Tenant must take all necessary steps to determine the facts of the accident, including a report to the police, noting the details of any other vehicle involved, the names and addresses of the persons involved and possibly witnesses, and making diagrams of the accident, etc. The Tenant must provide this information to Europcar. In case of significant damage, the Tenant must contact Europcar by phone immediately. Without the express consent of Europcar, the Tenant is not authorized to acknowledge any third-party claim as justified or to accept payment for damages, etc. If the Vehicle is no longer fit for circulation (due to an accident or other reasons), the Tenant will not have the right to transport it for free from the location where the damage or accident occurred. Europcar is not obliged to provide another vehicle or pay for damages in case of any delay due to the rental.
Insurance The Vehicle rented in Luxembourg will be covered by third-party liability insurance according to the general conditions approved by a government decree. The insurance company’s coverage may be limited in certain cases. Damage to property due to fire or explosion, regardless of whether it results from a traffic accident, is covered up to 1,239,467.62 euros. When Europcar has authorized the Tenant to drive the Vehicle outside Luxembourg, the third-party liability insurance will only be valid in the countries indicated in the insurance Green Card. In case of damage to the Vehicle, the Tenant will incur a deductible of 1,200 euros for vehicles in categories A, B, C, D, G, and K. For all other vehicle categories, the deductible will be 1,650 euros. These amounts are payable at the time and place the Vehicle is returned. For damages exceeding the above amounts, Europcar will accept payment to the extent that the insurance covers the damages. The Tenant, regardless of liability issues, must pay any damages not covered by the insurance, specifically in cases of damage occurring outside Luxembourg, including amounts resulting from the transport of the Vehicle to the repair location. Furthermore, the Tenant must pay any damages to third parties not covered by third-party liability insurance. The following cases require the Tenant to pay for all damages:
  • If, when returning the Vehicle to Europcar, the Tenant does not provide a properly completed accident report.
  • If the Tenant violates any of the conditions regarding the use or sublease of the Vehicle as outlined in these terms.
  • If the return of the Vehicle exceeds the agreed return time by more than 24 hours.
Vehicle Condition The Tenant is obligated to return the Vehicle to the agreed office during Europcar’s opening hours at the end of the rental period. The mileage will be calculated based on the odometer reading from the rental office to the return office. If the odometer fails, the calculation will be based on the distance on the map plus 10%, but with a minimum of 100 km per day, unless the Tenant can prove they drove fewer kilometers.
Portugal:
Applicable Law and Competent Court: These Terms and Conditions have been issued under Portuguese law and can be consulted at www.europcar.com hosted in Portuguese territory. Portuguese law is applicable, and the Courts of Lisbon will have jurisdiction as stipulated in Article 17 of Council Regulation (EC) No. 44/2001.
Privilege: In Portugal, members of the Privilege Program must sign the rental contract at the counter, as electronic signatures are not legally recognized as valid.
Spain:
Force Majeure: No party shall be held responsible in the case of Force Majeure. Force Majeure is defined as any irresistible, unpredictable event beyond the party's control, as defined by the Civil Code of Spain.
Vehicle Use: The Renter expressly agrees, under the provisions of Law 17/2005 of July 19 in Spain, to identify the driver of the vehicle at any time when required by Europcar for the purpose of notifications for fines or administrative sanctions. If, due to reasons attributable to the Renter, and when requested by a competent authority, Europcar is unable to correctly identify the driver of the vehicle for fine or sanction notifications, the Renter will be responsible for paying the fine or sanction issued to Europcar due to the failure to identify or incorrectly identifying the vehicle's driver under the aforementioned conditions. In such cases, Europcar will charge the Renter, who agrees, the amount of the fine or sanction in question.
Insurance: All vehicles in Europcar's fleet are covered by mandatory third-party insurance in case of an accident involving the vehicle, as per Royal Legislative Decree 8/2004 of October 29, which approves the Law on Civil Liability and Insurance in the Circulation of Motor Vehicles. The coverage amounts are available in the rental country.
Specifically, the Renter must comply with the regulations on permitted destinations, as set forth in the previous "Use of the Vehicle" section, to fully benefit from the insurance provisions.
Applicable Law and Competent Court: These Terms and Conditions will be interpreted in accordance with Spanish law. The Courts of Madrid will have jurisdiction over any disputes arising from or related to this contract.
Data Protection: In accordance with the provisions of Organic Law 15/1999 on the Protection of Personal Data and Law 34/2002 on Services of the Information Society and Electronic Commerce, both in force, EUROPCAR IB, S.A., a company incorporated under Spanish law, with its registered office at Avda. del Partenón, 16-18, 28042 Madrid (Spain), hereby informs the Renter that their personal data will be included in a file under the responsibility of this company for the purpose of providing services related to this contract, as well as: a) statistical and promotional purposes for postal mail and commercial information; b) debt recovery purposes; c) conducting quality control studies or satisfaction surveys; and d) sending information via any medium, including email or equivalent media, regarding products and services from EUROPCAR or complementary products/services. For commercial communications via email or equivalent media, the fact that the Customer has provided their data to EUROPCAR IB, S.A. is considered as granting their express authorization to send advertising material through these media.
The Renter may revoke their consent to receive the aforementioned information via email or equivalent electronic media by sending a notification to the following address: marketing.es@mail.europcar.com. This notification must be accompanied by proof of the Renter’s identity.
Europcar is an international company that maintains data banks in various countries. To facilitate the booking and/or rental processes, EUROPCAR IB, S.A. may need to transfer personal data to its data banks worldwide or to franchises or external partners to complete or improve car rental services. If the level of personal data protection in a country is not adequate, EUROPCAR will ensure that the transferred data is sufficiently protected. In this regard, the Renter is informed and hereby authorizes EUROPCAR IB, S.A., who collects their data, to make such data available solely for the purposes previously indicated.
EUROPCAR IB, S.A. hereby informs the Renter that the collection of such data is not mandatory for the services to be provided. However, failure to provide such data may prevent EUROPCAR IB, S.A. from providing all services associated with such data, releasing EUROPCAR IB, S.A. from any liability for the non-provision or incomplete provision of these services.
The Renter is informed of their right to access, rectify, cancel, and oppose the data by writing to EUROPCAR IB, S.A., Avda. del Partenón, 16-18, 28042 Madrid (Spain) to the attention of the "Marketing Department."
In any case, the Renter will be responsible for the authenticity of all the data provided, and EUROPCAR IB, S.A. reserves the right to exclude any Renters who have provided false data from the registered services, without prejudice to any other actions the company may take according to the law.
United Kingdom:
Miscellaneous
Road Traffic Law and Other Laws: The Renter hereby agrees to be responsible for and pay any notification or record received in relation to any offense committed under the Road Traffic Act during the rental period and for any other relevant loss related to the Vehicle and its use during the rental period that results in an imposition.
Customs and Excise Taxes: If the rented vehicle is seized by the Customs and Excise Authority and a fee must be paid, the Renter will be responsible for all costs, and the Customs and Excise Authority will charge it directly. Europcar will not be held responsible for this or any associated costs.
Insurance: The Third-Party Coverage ("TPC") provided by Europcar to the Renter (as required by the Road Traffic Act 1998) offers unlimited coverage for claims related to personal injuries or deaths resulting from the use of the vehicle, along with £250,000 coverage for property damage. Europcar's Liability Insurance rates are only available for Renters aged between 23 and 75 (74 years and 364 days). The Renter may purchase their own full insurance but must obtain prior written permission from Europcar and must provide Europcar with a valid coverage notification before the rental begins. Full details are available at Europcar's main office.
Payment Conditions: Value Added Tax: All Europcar prices are stated excluding VAT. Europcar will charge interest on any amount the Renter fails to pay on time at an annual rate of 15%. The Renter must also pay any losses and costs incurred by Europcar while preparing, executing, or attempting to enforce these terms. Credit Card Authorization: The credit card authorization requested will include the estimated rental amount plus an additional £150.
Confiscation, Theft, or Accident: If the vehicle or any of its parts or accessories is stolen, damaged, involved in a criminal act, or in an accident where someone is injured, the Renter must immediately contact the local police to report the incident. The Renter must call the rental office where the vehicle was rented and report the accident within twenty-four hours, providing Europcar with police details and any other information requested by Europcar. The Renter must also call the rental office where the vehicle was rented within 24 hours to report any other accidents in which the vehicle was damaged. If the vehicle is dangerous or unfit for the road after any incident, it should not be used.
The Renter must always:
  • Record the police report number and the officer's name if the police are involved;
  • Record the names, addresses, and phone numbers of all witnesses when applicable;
  • Avoid making any statements admitting fault for the accident;
  • Send all papers and documents received about the accident or damage to Europcar (including copies of any court documents and legal documents);
  • Complete Europcar’s Motor Vehicle Accident Report Form, sign it, and send it to Europcar within 48 hours of the loss or damage, otherwise, the insurers may refuse to consider the claim;
  • Cooperate fully with Europcar, insurers, and any other party designated by Europcar or the insurers. The Renter must authorize Europcar or the insurers or any other person designated by the insurers to take legal action or enforce rights on their behalf.
The Renter must do anything that Europcar or the insurers consider reasonably necessary to assist Europcar or the insurers in enforcing their rights for the loss or damage to the vehicle, its parts, and accessories during the rental.
If the Renter receives any money related to a loss or damage to the vehicle and/or its parts and accessories, they must return it to Europcar and, until they do so, hold it in trust for Europcar.
Breakdown Assistance: Breakdown assistance is provided through AA, with whom the Renter must contact immediately. This coverage provides assistance on all roads and highways in the UK.
Delivery and Collection Conditions: Europcar may confirm the delivery or collection of the vehicle at the location requested by the Renter, provided they cover the additional costs and follow any supplementary instructions. This information will be provided to the Renter at the time of booking. When returning the vehicle or leaving it for Europcar to collect, as agreed with the Renter, they must complete the details of: date, time of return, mileage, fuel level, and any other information indicated in the rental documentation. The Renter must also take any other action Europcar requests as a condition for vehicle collection.
The Renter must return the vehicle immediately if requested by Europcar. If the vehicle is not delivered to Europcar after being requested, the Renter hereby authorizes Europcar to enter their premises and take any necessary action to recover the vehicle. Any costs associated with this recovery will be charged to the Renter. Europcar may recover any vehicle without notice or responsibility if it deems such recovery necessary for its own protection.
France: Insurance: All vehicles are covered by a Third-Party Liability Insurance policy for motor vehicles as required by law. They also benefit from Roadside Assistance coverage. The Renter can also opt to take out optional Personal Accident and Luggage Coverage. The conditions and limitations applicable to mandatory and optional insurance and coverage, as well as Roadside Assistance coverage, are available in the Insurance and Assistance brochure, which is attached to the rental agreement.
Data Protection Law (January 6, 1978): In order to exercise the right to access or modify, or to oppose the communication of data related to the Renter to external commercial entities, the Renter must write to: Europcar France BP 19 78184 Saint Quentin en Yvelines Cedex.
Responsibility for Damage to the Rental Vehicle or Theft or Transformation: Insurance Cancellation: Drivers not listed on the rental agreement cannot claim coverage for damage or theft of the vehicle. Violating any of the explicitly stated obligations in the Terms and Conditions will void the coverage. In this case, the Renters will be responsible for all accident-related costs according to the Civil Liability Law.
Poland: Insurance: Europcar provides insurance according to the motor vehicle liability insurance policy only to those who use the vehicle with Europcar's authorization. Europcar is only responsible for losses or damages suffered by the Renter or third parties in relation to the vehicle or its use if such losses or damages occur deliberately or as a result of clear negligence by Europcar. Europcar will not be liable for any other events, and the Renter should not try to hold Europcar responsible for such claims.
Damage to the Rental Vehicle, Confiscation, Theft, Conversion, or Accident: If the vehicle has been damaged, stolen, or has lost any of its parts, whether it is the Renter's or a third party’s fault, the Renter will be charged the actual repair cost up to the value of the vehicle. If the loss is due to a third party, and Europcar receives compensation, the amount paid by the Renter will be reimbursed. If the Renter accepts the conditions for Collision Damage Waiver in the event of an accident and/or theft as stated on the first page of the rental contract, the Renter's liability in case of damage, theft, or loss of the vehicle or its parts may be limited to the actual repair cost up to the maximum amount indicated in the rental contract, provided the Renter has not breached any conditions stated in the rental contract. The Renter can cancel this responsibility by choosing the SCDW (Super Collision Damage Waiver) option, which cancels the Renter’s financial responsibility for vehicle damage, except for theft or fire. If the damage was intentional or due to driving under the influence of alcohol or drugs, the Renter’s liability will be unlimited.
In case of accident or theft, the Renter must immediately notify the police. The Renter will not have the right to accept claims from the other party. The Renter must notify Europcar without delay of any fire, theft, or accident damage. Even if the damage is minor, the Renter must submit an accident report along with a description of the situation to Europcar. The accident report must specify, especially, the names and addresses of the people involved and the witnesses, as well as the license plate numbers of the cars involved.
Switzerland: Optional Contractual Guarantees: Acts of vandalism are covered by the CDW option, but not by Theft Liability Waiver.
General Data Protection: Europcar provides car rental services to individuals and businesses. The collection, processing, and use of data enable Europcar to fulfill this purpose. You will be asked to provide your name, address, credit card number, email address, and phone or fax number. We use this information to confirm and process your booking or inquiry, as well as for internal purposes. If you rent a car, we will also store additional information such as your driver's license number, validity date, passport number, or identity document, work or home address (driver identity), and certain preferences. For some customer cards or contracts between Europcar and other legal or private entities, additional information is requested, as indicated in the relevant contracts.
Use and Transmission of Personal Data: Europcar uses your data for its own purposes and may partially communicate them to partner companies in Switzerland and abroad to facilitate the car rental process. Data (driver's identity) required for rental contracts help us and our partner companies process pickup and return procedures more quickly. Europcar allows public authorities to view the collected data in compliance with legal regulations.
United States: The Privilege Program does not exist in the United States.
