1. PREAMBLE EUROPCAR IB, S.A., a Spanish company with its registered office at Avda. del Partenón 16-18, 28042 Madrid, registered with the Madrid Commercial Registry, and with VAT number A-28364412 (hereinafter "Europcar") grants the following special terms and conditions regarding Europcar’s commercial offer (hereinafter the "Special Conditions"). These Special Conditions are agreed between Europcar and any company that wishes to take advantage of Europcar’s commercial offer (hereinafter the "Offer") (hereinafter the "Commercial Customer"). These Special Conditions will come into effect from the date the Commercial Customer registers online for the Offer. Europcar reserves the right to modify these Special Conditions at any time, provided that the applicable national public order provisions for current contracts are met. These Special Conditions can be consulted in English/Spanish at any time on the website https://www.europcar.com/business/register-online.
2. OBJECT The purpose of these Special Conditions is to define the conditions and modalities of the Offer, its conditions, and the application conditions, the Offer that allows the authorized legal representative of the Commercial Customer and any of its employees (hereinafter individually the "Beneficiary" and collectively the "Beneficiaries") to rent a vehicle at a reduced rate for professional and/or personal use, from the date the authorized legal representative of the Commercial Customer registers online for the Offer.
3. CONDITIONS To benefit from the Offer, the following cumulative conditions must be met: 3.1 Be authorized to create an online account and create an online account. 3.1.1. To be authorized to create an online account, the following cumulative criteria must be met:
  • Be the authorized legal representative of a company,
  • Engage in a professional activity,
  • Have a SIRET registration number, VAT number, or a company CIF;
  • Have a valid and working professional email address; 3.1.2. To create an online account: The duly authorized legal representative of the Commercial Customer must register online and create an account through the website https://www.europcar.com/business/register-online, fully completing Europcar’s online registration form. In this sense, the duly authorized legal representative of the Commercial Customer must answer a question regarding the calculation of vehicle rentals per year. The reduced rate granted by Europcar (as further detailed in Clause 6.3 of these Special Conditions) will be the result of this calculation and may be reviewed, if Europcar deems it appropriate, after a period of twelve (12) months, additionally considering the actual vehicle rentals reserved by the Commercial Customer and its Beneficiaries over the year (as further detailed in Clause 6.3 of these Special Conditions). Once the Commercial Customer has confirmed their online registration, Europcar will send:
  • An electronic acknowledgment receipt to the Commercial Customer’s professional email address, which will constitute the final acceptance of the Offer by the Commercial Customer; and
  • The special code for the Commercial Customer’s company (hereinafter, the "Special Code"). 3.2 Be the authorized legal representative of the Commercial Customer or an employee of the Commercial Customer who meets the following criteria:
  • Be authorized to drive a vehicle in accordance with Europcar’s current general rental terms and conditions, available on the website https://www.europcar.com/terms-and-conditions (hereinafter "Europcar’s General Rental Terms and Conditions") and with Europcar’s current Insurance and Protection policy, available at https://www.europcar.com/terms-and-conditions/insurances-and-protection, which can be obtained at all Europcar rental offices participating in the Offer (hereinafter individually the "Europcar Participating Rental Office" or collectively the "Europcar Participating Rental Offices" as defined in Clause 6.1 of these Special Conditions), and which will determine in particular the conditions for the age of the driver’s license and the accepted payment methods, as well as the category of the rented vehicle;
  • Not have benefited from any other reduced rate from Europcar by any other means, as the benefits of the Offer cannot be used in combination with other offers or promotions, unless Europcar allows it;
  • Have a valid "accepted" credit card, as stated on Europcar’s website https://www.europcar.com/en-us/p/legal-information (hereinafter, the "Accepted Credit Card"), whose details must be encrypted through a secure platform;
  • Satisfy these Special Conditions. 3.3 Have read and accepted these Special Conditions, Europcar’s General Rental Terms and Conditions, and Europcar’s Insurance and Protection policy. 3.4 Refusal of registration or reduced rate Europcar reserves the right not to accept the Commercial Customer’s online registration or to refuse to allow a Beneficiary to enjoy a reduced rate if a Beneficiary has a debt with Europcar or has previously violated Europcar’s General Rental Terms and Conditions or its current Insurance and Protection policy, or if a Beneficiary does not meet the conditions outlined in Clause 3 of these Special Conditions.
4. EFFECTIVE DATE AND TERM OF THE SPECIAL CONDITIONS Beneficiaries may enjoy the Offer immediately from the date of the Commercial Customer’s authorized legal representative’s online registration for a period of twelve (12) months, which is renewable at the end of this period for additional periods of twelve (12) months, unless either Party terminates it in accordance with the provisions of Clause 5 "Termination" of these Special Conditions.
5. TERMINATION 5.1 Termination for default If either party fails to comply with any of the terms and conditions of these Special Conditions, the affected party, without waiving other rights or remedies available to them under these Special Conditions or applicable law, may notify the other party of the default, and if it is a default that can be remedied, if the other party does not remedy it within fifteen (15) business days from receiving the notice, the affected party may close the account with immediate effect. 5.2 Termination by the Commercial Customer – cancellation of subscription – account closure 5.2.1 The Commercial Customer may send a request to Europcar to cancel their subscription at any time to the following address: admventas.es@europcar.com 5.2.2 In the event of changes to these Special Conditions, Europcar will notify the Commercial Customer by email to their professional email address, and the Commercial Customer may cancel the subscription and close their account by sending an email to Europcar at the following address: admventas.es@europcar.com, with seven (7) business days’ notice. In this case, the account will be deleted within fifteen (15) business days. If the Beneficiaries have benefited from a reduced rate, Europcar may cancel the reduction of these advantages by issuing a new invoice for any service already provided at the best public rate available on the rental day. The Commercial Customer and their Beneficiaries acknowledge and accept that this operation will be carried out using the Accepted Credit Card. If the Accepted Credit Card does not allow the mentioned operation, the Commercial Customer agrees to pay the rectified invoice immediately after receipt. 5.3 Cancellation or suspension of the offer by Europcar Europcar may cancel or suspend the Offer in the event of a breach of Europcar’s General Rental Terms and Conditions, the current Insurance and Protection policy, or these Special Terms and Conditions of Europcar’s commercial offer, in the event that the account is not used for a period of two (2) years, etc. In the event of cancellation or suspension of the Offer by Europcar, Europcar will notify the Commercial Customer by email at least two (2) months before cancellation or suspension of the Offer. Europcar will make every effort to suggest an alternative similar offer. The Commercial Customer is not obliged to accept it. 5.3 Effects of Clauses 5.1 to 5.3 inclusive As a result of Clauses 5.1 to 5.3 inclusive of these Special Conditions, Europcar will close the Commercial Customer’s account within fifteen (15) business days, and the Beneficiaries will not be able to enjoy a reduced rate.
6. SPECIAL CONDITIONS OF THE OFFER These Special Conditions complement Europcar’s General Rental Terms and Conditions, which remain in effect. In the event of any conflict between these Special Conditions and Europcar’s General Rental Terms and Conditions, or any other provisions, the provisions of these Special Conditions shall prevail. 6.1 Europcar rental offices participating in the Offer (hereinafter the "Participating Europcar Rental Offices") To enjoy a reduced rate, rentals must be made at a Participating Europcar Rental Office. Europcar offices worldwide participate in the Offer. This includes Europcar branches and franchised offices. Europcar International Partner Alliance offices do not participate in the Offer (this includes offices in the US territory operated by Discount and in the Canadian territory operated by Advantage, and any future Partner Alliance offices).
6.2 How the Offer Works Creating an account does not guarantee the availability of vehicles nor offer additional insurance coverage for the Beneficiaries. For each vehicle rental, each Beneficiary agrees to comply with these Special Conditions and the General Terms and Conditions of Europcar, as well as the current Europcar Insurance and Protection policy. Each Beneficiary will sign a rental agreement for each vehicle rental. The rules corresponding to each vehicle category must be followed. The number of active vehicle rental contracts is limited to one (1) per Beneficiary.
6.3 Benefits of the Offer
6.3.1 Each Beneficiary, subject to the supply/entry of the special Code and at any of the Participating Europcar Rental Offices, before any rental, upon presentation of proof that they are an employee of the Corporate Client (e.g., a company business card, company document, etc.), will enjoy a reduced public rate for each of their rentals during the period mentioned in Clause 4, as follows:
  • For corporate clients with fewer than fifteen (15) vehicle rentals per year:
    • 5% (five percent) discount on all Europcar rentals;
  • For corporate clients with fifteen (15) or more vehicle rentals per year:
    • 10% (ten percent) discount on all Europcar rentals, or
    • A fixed rate that will apply to all Europcar rentals booked during the Initial Period. This fixed rate will be determined by the rental volume based on the Beneficiary’s estimated reservations during the Initial Period (see section 3.1.2) and will be calculated based on more or fewer than 15 rentals per year.
6.3.2 This reduced rate will depend on the information provided by the authorized legal representative of the Corporate Client to Europcar regarding the calculation of their vehicle rentals per year during the online registration. In the event that, after the first twelve (12) months have passed, the number of vehicle rentals is lower than the calculation initially provided by the Corporate Client’s authorized legal representative in their online registration, Europcar reserves the right, if deemed necessary, to review the reduced rate assigned to the Corporate Client and their Beneficiaries. If any changes occur, Europcar will notify the Corporate Client by email.
These reduced rates will apply to the base public rate (excluding taxes), excluding insurance, taxes, non-refundable deductibles, fuel, and other optional services. The advantage of these reduced rates is subject to vehicle availability in the Europcar fleet at the time of booking.
These reduced rates include:
  • Partial damage liability waiver in case of an accident (Collision Damage Waiver, CDW);
  • Partial theft exemption (Partial Theft Waiver, TW);
  • Office charge (if applicable).
6.3.3. If the rental duration:
6.3.3.1 is up to 27 consecutive days, it will include 350 km per day for the first 2 days, and from the third day of the rental onward, the mileage is usually unlimited, except in certain countries where a mileage limit applies. The mileage inclusions will be specified for each country at the time of booking.
6.3.3.2 If the vehicle rental extends beyond 28 consecutive days at any time, a 6000 km/month allowance for cars and 5000 km/month for vans will apply to the entire rental period based on the number of 28-day periods. This mileage allowance will apply regardless of the number of vehicles Europcar provides, as long as the rental is continuous.
6.3.3.3 If the rental is initially planned for a minimum period of 28 days, fixed rates may be available for certain vehicle groups. 6.3.3.3.1 A mileage allowance of 3000 km/month for cars and 2500 km/month for vans will apply to the entire rental period based on the number of 28-day periods that make up the total rental. 6.3.3.3.2 CDW coverage will be subject to a deductible as specified in the fixed-rate price guide, instead of the amount specified in the public rate guide. If the rental is canceled before the minimum 28-day period expires, Europcar reserves the right to apply the price of the rates as outlined in section 6.3.1. 6.3.3.3.3 Both products (cars and vans) will have a 5% discounted version for more than 10 units.
6.3.4 The Offer is available for bookings made through any of Europcar’s booking channels (particularly, but not exclusively):
  • Europcar websites or,
  • Participating Europcar Rental Offices,
  • Europcar’s call center available at the following phone number: 911505000, or via email at reservations.es@europcar.com. Subject to the supply or entry of the special Code and, at any Participating Europcar Rental Offices, before each rental, subject to the presentation of proof that the person is an employee of the Corporate Client (e.g., a company business card, company document, etc.).
6.3.5 Reduced rates cannot be converted to cash or exchanged for other products or services.
6.3.6 Reduced rates cannot be combined with other promotions, discounts, vouchers, special promotional rates, or corporate rates that Europcar may offer unless Europcar allows it.
6.3.7 Rentals made under this Offer are subject to Europcar’s General Terms and Conditions, the current Europcar Insurance and Protection Policy at the time of signing the rental agreement, and available at the following address: https://www.europcar.com/terms-and-conditions, as well as in each Participating Europcar Rental Office.
6.3.8 The benefit of a reduced rate does not include the provision of any insurance coverage other than Europcar's Basic Protection package. Any other protection package must be purchased separately.
6.3.9 Europcar may modify the reduced rates at any time. Europcar will email the Corporate Client to notify them of such changes.
7. SUFFICIENT PROOF OF ONLINE SIGNATURE
The purpose of this clause is to define the conditions under which the Commercial Client and Europcar assign the same value to any electronic document as that of an original document and accept it as evidence in the same way as if it were a handwritten signature on a printed copy. The "simple click" on the "Subscribe" button by the Commercial Client for the acceptance of these Special Conditions will constitute an electronic signature, which will have the same value between the Commercial Client and Europcar as a handwritten signature. The electronic documents will be created and preserved in conditions that guarantee their integrity and allow them to be considered as evidence of the Commercial Client's online registration. These electronic documents must be stored on a reliable and durable backup medium that can be presented as evidence.
8. APPLICABLE LAW – DISPUTE RESOLUTION – ASSIGNMENT OF JURISDICTION
These Special Conditions shall be governed by Spanish law. In the event of any difficulty in fulfilling the obligations contained in Europcar’s General Rental Terms and Conditions and in these Special Conditions, the parties agree to seek an amicable solution. When it is not possible to resolve the conflicts that may arise regarding the aforementioned conditions amicably, they will be resolved within the jurisdiction of the competent court in the city of Madrid.
9. DATA PROTECTION
  1. Who processes your personal data? EUROPCAR IB, S.A., whose registered office is located at Av. Partenon 16-18 Madrid, is responsible for processing your personal data (i.e., the information that could identify you, directly or indirectly) collected through this website. The terms "Europcar," "we," or "our" used in this policy refer to EUROPCAR IB, S.A. According to applicable data protection laws, EUROPCAR IB, S.A. is the "Data Controller." EUROPCAR IB, S.A. is a member of the Europcar Mobility Group. The term "our Group" refers to the Europcar Mobility Group. When you provide Personal Data or when we collect Personal Data about you, we are committed to using it in accordance with this Policy.
  2. What personal data can we collect? As a provider of mobility solutions, we collect and process various categories of personal data in relation to this website and our mobile applications in order to provide you with our products and services. Personal Data refers not only to data that directly identifies you but also data that indirectly identifies you. The categories of Personal Data that we collect in the context of our services and the use of our website and mobile applications include the following:
  • Your identifying data: surname, first name, email address, phone number, postal address, account identifier,
  • If applicable, identifying data of the driver or additional drivers: surname, first name, email address, phone number, postal address,
  • Your driver’s license and that of any other driver,
  • Payment data: account numbers, card numbers, etc.,
  • Financial data: your invoices,
  • As applicable, data related to traffic violations,
  • Flight information if the vehicle pickup location is an airport,
  • Information about your vehicle reservation, in particular to feed loyalty programs of which you would be a member,
  • Data related to your navigation on our website or mobile applications,
  • Data related to your satisfaction surveys or interactions on our social media pages,
  • Voice, audiovisual, and electronic data: recordings of your communications via email, chat, or phone with our customer service department,
  • Information collected through our Connected Vehicle (if the vehicle you rent is a connected vehicle): vehicle status, damage or accident information, vehicle performance data, operational and diagnostic data, mileage information, acceleration and braking speeds, fuel consumption and levels, tire pressure, odometer readings, vehicle location, and other related information.   • Data related to cookies and other similar technologies. For information about the use of cookies, please refer to our policy.
We collect most of your personal data directly from you, but we may also receive data from third parties, including the competent authorities responsible for managing fines for traffic violations.
3. What purposes do we process your personal data for?

These treatments are necessary for the reservation and the fulfilment of your rental contract with us. You may choose to register your credit card for additional payments.
Driving licence verification. This validation may be performed (i) manually by our customer service or (ii) using a facial recognition device.
(i) This processing is necessary for the performance of the rental services contract you have entered into with us. (ii) The use of the facial recognition solution is based on your consent.
Fighting credit card fraud
This processing is based on our legitimate interest in protecting ourselves against credit card fraud.
Conduct satisfaction surveys to improve your experience with our products/services.
This processing is based on our ‘legitimate interest’ to better understand our customers' needs and to improve our services and customer service.
Chat in real time on our website to provide you with initial online support
This processing is based on our legitimate interest in attending to and resolving your queries about our products and services.
To carry out marketing and promotional activities, including: i. sending you email and SMS notifications for promotions / special offers; ii. recording your rental history to suggest your preferred products / services when seeking new bookings / rentals; iii. the management of your loyalty programme and membership card; iii. the management of your loyalty programme and membership card; iv. the management of your loyalty programme and membership card. membership card; iv. sending you emails about a booking you have not completed or a summary of a booking enquiry; v. organising promotional competitions and prize draws; vi. managing and updating our customer/prospect database.
Our marketing and commercial activities, i.e.: sending commercial communications to promote our products / services are subject to your consent. In the event that you are already our Customer you may receive commercial communications about products / services similar to those you have contracted. The sending of these communications will be based on our ‘legitimate interest’ in promoting our products and services. Other processing included in this category (v and vi) is based on our legitimate interest in carrying out our business.
The management of fines for infringements, in particular: i. to transfer to the competent authorities the identity of the driver (or potential driver); ii. to comply with the fine collection procedure to which we may be subject.
This processing is based on compliance with the legal obligations to which we are subject, specifically, the Royal Legislative Decree 6/2015 of 30 October, which approves the revised text of the Law on Traffic, Circulation of Motor Vehicles and Road Safety.
The management and maintenance of the blocking of the account of customers with contractual risks based on: - payment incidents that have resulted in legal proceedings; - vehicle accidents or repeated damage or offences to our employees; - use of our vehicles in breach of the general conditions of vehicle rental.
This processing is based on our legitimate interest, in particular the defence of our rights, to prevent risks and fraud related to the execution of your lease and to prevent and manage offences towards our employees. In this respect, we try to maintain a fair balance between the need to process your personal data and respect for your rights and freedoms, in particular the protection of privacy. This processing activity is based on our legitimate interest in ensuring the security of goods and persons on our premises, either as a deterrent or so that the perpetrators of damage, theft or assault can be identified.

4. Who are the recipients of the personal information we collect about you? 4.1 Categories of recipients Your personal data will be disclosed, as necessary/relevant, to:a. authorised personnel of EUROPCAR IB and entities of the same group and/or entities of the EUROPCAR IB franchise network, or to agents/sales intermediaries appointed by EUROPCAR IB, for the purposes described in this privacy policy;b. our subcontractors, in particular our IT service providers for hosting, maintenance or development, who assist us in providing their products/services to you. These providers may be entities that are members of our Group or external service providersc. advertising agencies, marketing agencies, social media and digital agencies to help us conduct advertising, marketing and sales campaigns and to analyse the effectiveness of these campaigns;d. about information necessary for the processing of fines, to Gesthispania or its foreign counterparts in the case of fines committed abroad;e. to our partners or those of our Group, in particular to enable you to accumulate loyalty points when you are a member of their programme:

List of Europcar España members: f. in relation to information processed for the payment of fines, to the competent traffic authorities, provided for by Royal Legislative Decree 6/2015, approving the revised text of the Law on Traffic, Circulation of Motor Vehicles and Road Safety or to their foreign counterparts in the case of fines committed abroad. g. Insurance companies to provide roadside assistance and accident assistance to drivers with whom we have contracted. h. Public entities: Administrador de Infraestructuras Ferroviarias (ADIF), Aena SME, S.A., (AENA), in order to fulfil the contractual obligations we have assumed in the agreements signed with these entities... i. SECURITIFLEET S.L., owner of our fleet of vehicles, as well as, where appropriate, other financial institutions owning our vehicles and/or any company in our Group, for the sole purpose of complying with the obligation to identify the driver before the competent authority in the event that a traffic offence is committed with the vehicle that has been rented both in Spain and in other EEA countries and, in particular, the Netherlands.
j. Solvency files: in the event that you have a debt with us that is certain, due and payable, and we have previously required you to pay but you have not paid it within the time limit set out in the General Terms and Conditions, we may transfer this information to an information file - database - on solvency and creditworthiness.
4.2 Use of Facebook All Facebook features and services available on our website or application are governed by Facebook's Privacy Policy, which you can read to learn more about your rights and settings options. When using one of our websites/applications, you may: Use Facebook social plugins, such as ‘liking’ or ‘sharing’ our content from the Facebook Platform;Accept cookies from our website or apps (also known as ‘Facebook Pixel’), which will help us understand your activities, including information about your device, how you use our services, the purchases you make, and the ads you see, whether or not you have a Facebook account or are logged into Facebook. When you use these Facebook features, we collect data that helps us to:Display ads that may be of interest to you on Facebook (or Instagram, Messenger or any other Facebook service);Measure and analyze the effectiveness of our website, apps and ads.
4.3 International Transfers In order to provide you with our products and services, we may use service providers located outside the European Union (in particular in the United States, Morocco and Israel). In case the vehicle is booked abroad, data transfers will take place in the country concerned in order to provide you with our mobility solutions. Depending on the circumstances, some recipients may be located in countries recognised by the European Commission as having an adequate level of protection for personal data or in countries that have not been recognised by the European Commission as having such a level of protection. In any case, we have implemented adequate protection measures to protect your personal data in accordance with data protection regulations.
5. How long will we keep your personal data? Your personal data will be kept for different periods, depending on the purposes of the processing:

The data is kept for a period of 12 months. In the case of property damage or crimes, damage investigations, and accidents caused to the vehicle, personal data may be retained until the cases are resolved (even until the filing or resolution of any legal or judicial proceedings).

Promotional and marketing activities:

iv. Sending emails about an incomplete reservation or a summary of an inquiry about a reservation;
v. Organizing contests and promotional giveaways;
vi. Managing and updating our customer/prospect database.
If you are our customer, 3 years from the end of the contractual relationship. If you are not a customer, 3 years from the collection of your personal information or from the last request for information made.
Payment of fines
For the time necessary to identify the driver (or potential driver) responsible for the violation that leads to the fine. However, the relevant information may be retained for a longer period, from the time the fine is received, subject to an intermediate archiving policy.

- vehicle accidents or repeated damages or offenses against our employees;
- use of our vehicles in violation of the general rental conditions.

30 days from the recording. If there are signs of a crime or damage to our property or the people present in the facilities, they may be kept for as long as necessary to resolve the corresponding claims or legal actions.
6. What rights can you exercise regarding the processing of your personal data?
Within the limits and conditions permitted by current regulations, you can:
a. Access your personal data and obtain additional information about the characteristics of our processing;
b. Request the correction, update, and deletion of your personal data. However, deletion can only be carried out when: (i) your data is no longer necessary in relation to the purposes for which it was processed, (ii) you withdraw your consent and there is no other legal basis for processing, (iii) you object to the processing of your personal data and there is no legitimate reason for the processing, (iv) it is determined that your personal data has been processed illegally, (v) the personal data must be deleted to comply with one of our legal obligations;
c. Object to the processing of your personal data for your own reasons;
d. Object to the processing of your personal data for commercial prospecting purposes;
e. Receive the personal data you have provided or request us to communicate it to a third party when the processing of your personal data (i) has been carried out by automated means and (ii) is based on your consent or the execution of a contract binding us;
f. Request the limitation of the processing of your personal data, meaning that we will not be able to use your personal data for a defined period. You may exercise this right when: a) You contest the accuracy of your personal data for a period that allows us to verify its accuracy; b) The processing of personal data is unlawful, and you oppose the deletion of your personal data, instead requesting its restriction; c) We no longer need your personal data, but it is still necessary for the establishment, exercise, or defense of legal claims; d) You object to the processing based on your specific situation while we check if the legitimate reasons pursued by Europcar IB S.A. override your reasons.
g. Withdraw your consent for processing based on your consent;
h. File a complaint with a Supervisory Authority. In Spain, the Supervisory Authority is the Spanish Data Protection Agency in Madrid, c/Jorge Juan, 6 or on the website: www.agpd.es.
